SC seeks response from Jammu and Kashmir on Mehbooba Mufti’s detention under PSA

The Supreme Court on Wednesday issued notice to the Jammu and Kashmir administration seeking response on the detention of People Democratic Party (PDP) leader and former Chief Minister Mehbooba Mufti under the Public Safety Act, listing the matter for next hearing on March 18.

A three-member bench headed by Justice Arun Mishra heard the Habeas Corpus plea by Iltija Mufti challenging the detention of former Jammu and Kashmir Chief Minister and her mother Mehbooba Mufti who has been detained under the Public Safety Act.

Justice Mishra asked the petitioner the reason for filing the petition. “What is the issue? What are the grounds?” asked Mishra.

The petitioner told the court that it’s a Habeas Corpus petition and the Mehbooba Mufti’s detention under PSA is based on a dossier full of personal remarks. She also told the court the ground on which Mufti is detained is hate speech. “The Impugned Dossier describes Mehbooba Mufti ‘s politics as cheap and her mindset variously to be communally divisive and that the main motive of the Detenu is to create an atmosphere of fear and chaos.”

Justice Mishra said that the court will look into the grounds of the case.

The court asked the petitioner why she didn’t approach the Jammu and Kashmir High Court. The petitioner said, “HC has refused to take up the matter against administrative action. That’s why all the writ petitions are filed before this court.”

The court also asked Iltija Mufti to file an affidavit in the Supreme Court that no case is pending regarding this issue before High Court by today afternoon.

The matter will be heard on March 18.

In a similar case, the SC had earlier issued notice to the Jammu and Kashmir administration on the detention of another former Jammu and Kashmir Chief Minister Omar Abdullah under PSA.
