Munawar Faruqui moves Supreme Court for bail, to be heard tomorrow

Dismissing Faruqui's bail, the Court said it is a constitutional duty of every citizen to promote brotherhood and harmony

Stand-up comic Munawar Faruqui has moved the Supreme Court for bail late on Thursday. The bench of Justices R.F. Nariman and B.R. Gavai will consider the special leave petition filed against the order passed by the Madhya Pradesh High Court on January 28.

Faruqui’s appeal comes after the High Court rejected his bail plea. The comic was arrested on January 2 following complaints by a BJP leader’s son for allegedly hurting Hindu sentiments in a comedy show in Indore. Dismissing Faruqui’s bail, the Court had said it is a constitutional duty of every citizen to promote brotherhood and harmony.

The complaint was filed against Faruqui and others by Eklavya Singh Gaur (36), son of local BJP MLA Malini Laxman Singh Gaur, for allegedly passing indecent remarks about Hindu deities and Union Home Minister Amit Shah during a show. Later, a local court had then sent them to judicial custody. Faruqui was booked under IPC Sections 295A (outraging religious feelings) and 269 (unlawful or negligent act likely to spread the infection of any disease dangerous to life) among other charges.

On January 28, the single-judge bench of Justice Rohit Arya of the MP High Court dismissed the bail applications filed by Faruqui and the show’s organizer Nalin Yadav observing that no case was made out for grant of bail.
