Uttarakhand High Court issues notice on PIL raising questions over converting multi-level car parking to one room tenements

The Uttarakhand High Court issued notice on a Public Interest Litigation (PIL) filed raising the grievance that the Nagar Palika Parishad (Mussoorie) has converted the use of multi-level car parking to one room tenements to be allotted to the homeless.

Vikas Bahuguna , Counsel for the petitioners pointed out in the High Court that the said conversion of userby the impugned resolution is illegal. Hefurther submitted that even the fire clearance is not granted. Even Mussoorie-Dehradun DevelopmentAuthority vide communication 22.02.2013has raised objections to the raising of the construction.

The Counsel for the respondents authorities submitted that the notice dated 22.02.2013relates to some other property. This is disputed by the Counsel for the petitioners.

While considering the PIL , the Division Bench of Chief Justice Vipin Sanghi and Justice Ramesh Chandra Khulbe issued notice to the respondents and directed that till the next date, one room apartments,which have been constructed, shall not be allotted to or be occupied by any person.Any construction, which has already been undertaken or which may be undertaken henceforth shall be subject to further orders of the Court and no equity shall be claimed by the respondents in this regard.

Matter is listed on 22.12.2022 for further hearing.
