After a long drawn out battle for Justice the four convicts namely, Akshay Kumar Singh, Pawan Gupta, Vinay Sharma and Mukesh Singh, who were accused in the 2012 Delhi Gang Rape case, were executed today at 5.30 am in Tihar Jail.

The four people were accused of rape and murder of a 23 year old medical student in December 2012. After more than seven years of the incident justice was served and the convicts were hanged. The horrific crime was committed on a moving bus in South Delhi and was termed by the Supreme Court as “rarest of rare” case.
The convicts were executed after the Delhi High Court and the Supreme Court heard the matter in the night. The counsel for the convicts had moved the Delhi High Court against the order of the trial court. The Delhi High Court dismissed the petition. The counsel then moved the Supreme Court.

The Supreme Court heard the matter at night where Pawan’s juvenility claim was also raised along with the claim that the second mercy was rejected by the President without considering it with an open mind. Advocate Khwaja appearing for the convicts submitted, “President’s decision was not taken in bonafide manner. President has not taken the decision with open mind nor with due application of mind.” The Supreme Court rejected both the prayers.

Earlier, three of four convicts in the case approached the International Court of Justice (ICJ) seeking a stay on the execution of their death sentence, news agency ANI reported. The execution date set by the Trial Court had also been deferred three times.

There were a total of six convicts in the matter out of which one Ram Singh committed suicide while he was in custody and the other one was a juvenile who was released after serving three years in a juvenile correctional facility.

Supreme Court today dismissed a Curative Petition filed by Pawan Kumar Gupta, one of the co-convicts of 2012 Delhi Gang Rape Case. Pawan had filed the curative petition to commute his death sentence into life imprisonment claiming that he was a minor at the time of the incident.

A six judge bench of the apex court comprising of Justices N. V. Ramana, Arun Mishra, R. F. Nariman, R. Banumathi, Ashok Bhushan and A. S. Bopanna dismissed the petition stating that, “In our opinion, no case is made out within the parameters indicated in the decision of this Court in Rupa Ashok Hurra vs. Ashok Hurra & Another”.

Earlier, three of four convicts in the case approached the International Court of Justice (ICJ) seeking a stay on the execution of their death sentence, news agency ANI reported.

It came shortly after the Supreme Court ordered the petition filed by convict Mukesh Singh seeking action against his former lawyer Vrinda Grover to be withdrawn. Mukesh Singh, appealed in the Supreme Court seeking restoration of all his legal remedies, alleging that his lawyers had misled him. The plea moved through advocate ML Sharma, had asked for a CBI probe into alleged “criminal conspiracy” hatched by the Centre along with Delhi government and Vrinda Grover, who was amicus curiae in the case.

All the four convicts are scheduled to be hanged on March 20 at 5.30 am after a trial court in Delhi issued fresh death warrants for the fourth time.
