The Delhi High Court on Thursday has put a stay in the trial court proceedings in the defamation case filed against BJP leaders Hans Raj Hans and Manjinder Singh Sirsa by Delhi Deputy Chief Minister Manish Sisodia.

The Delhi Deputy CM Sisodia had sued Hans and Raj Hans and Majinder Sirsa along with other BJP leaders including Manoj Tiwari and Vijender Gupta for defamation when they alleged his involvement in a corruption scam of nearly ₹2,000 crore related to the construction of new classrooms in Delhi’s government schools.

The Justice Dinesh Kumar Sharma has put a  stay in the the proceedings today after Hans and Sirsa filed pleas challenging the summoning order of November 2019 issued against them by the Additional Chief Metropolitan Magistrate (ACMM).

Last month a lower court had rejected an application of the BJP leaders seeking discharge in the same case.

Senior Advocates Kirti Uppal and Pawan Narang who appeared on behalf of the BJP leaders argued that one of the summoned persons (Vijender Gupta) had gone to the Supreme Court and obtained relief.

They also added that the Supreme Court has returned a finding that the tweet by Gupta is not defamation, it also added that the case against Hans and Sirsa also needs deliberation and examination.

The Court after hearing the senior lawyers, issued notice to Sisodia and listed the case for further consideration on March 10.
