Advocate Suraj Prakash appearing for Girdhar said that he has been wrongly implicated in the present case, and is languishing in judicial custody since the day of his arrest.

The appellant was convicted by the First Additional Sessions Judge, Mahasamund, Chhattisgarh, under Section 376(1) of the Indian Penal Code, 1860, and was awarded seven years rigorous imprisonment and a fine of Rs 5000, in default whereof to undergo further rigorous imprisonment for 1 year.

Additional Sessions Judge Deepak Dabas transferred the matter to District and Sessions Judge (Headquarters) to decide who will hear the matter.

Additional Sessions Judge Dharmendra Rana of the Patiala House Courts refused to grant any interim relief and slated the matter for further hearing on Saturday, March 27
