The Allahabad High Court on Wednesday has granted conditional anticipatory bail to Mukhtar Ansari's wife Afsan Ansari. The Court, while granting anticipatory bail till the Court takes cognizance of the Police report, has directed the Petitioner to abide by the bail conditions.

The Court has sought the response of State Government and directed it to file counter affidavit within three weeks. The Court put up this matter for hearing on 21/01/2021, and directed to release Petitioners on interim anticipatory bail till then in the event of their arrest.
A single bench of Justice Vibhu Bakhru called the issue a controversial one and allowed the anticipatory bail application on conditions that the petitioner shall continue to cooperate with the investigation officer and appear before him whenever required.
The Allahabad High Court has said that anticipatory bail can be granted even after the filing of the chargesheet in a criminal case and taking cognizance by the magistrate thereon, and any time till the trial is over.
The Court was hearing a Special Leave Petition filed challenging the Punjab and Haryana High Court decision refusing anticipatory bail to the petitioner in a case under Sections 354, 506 (criminal intimidation), 341 (wrongful restraint), and Section 34 of the Indian Penal Code.
