A single-judge bench of Allahabad High Court while hearing a petition filed by Radha Kant Tripathi directed the Basic Education Council to consider the issue of appointment of husband and wife in the same District in the context of inter-district transfer.

The Allahabad High Court has put a stay on the proceedings of the order to call the assistant teacher appointed in the disability quota for physical verification for the third time, despite the confirmation of 40 percent disability twice.

The petitioner is in no manner responsible for non-joining of Satye Singh Aswal at the transferred place, the Counsel for the petitioner submitted. According to him, the respondent-authority is not justified in passing the impugned order against the petitioner for a lapse committed by Satye Singh Aswal.

The petitioners have cited extreme family circumstances being serious ailment suffered by his wife i.e. Cancer, as the reason for the transfer sought.

The court order seeking appointment of successful candidates for the position of assistant Teacher was not being followed, the court observed.

The Basic Shiksha Adhikari Gorakhpur stopped the salary of the Petitioner who had joined the post of assistant teacher in Gorakhpur on the grounds that Petitioner received two years of D.El.Ed. training after intermediate from Rajasthan.
