The Supreme Court on Tuesday asked the Central Bureau of Investigation (CBI) to file an affidavit on an interim bail plea filed by 74-year-old former Congress leader Sajjan Kumar on health grounds, who was convicted in the 1984 anti-Sikh riots case.
Hon’ble Bench of two Supreme Court Judges directed the man Nilesh to deposit 30 lakh amount before the trial court. The court noted that Nilesh had already withdrawn the petition before the Gujarat High Court.
The case was related to the custodial death of an accused, who was arrested in a case of alleged rape and murder of a 16-year-old school girl in Kotkhai area of Shimla district. The trial in the 2017 case was transferred to Chandigarh on orders of the Supreme Court.
“Accordingly, the Anticipatory Bail Application is dismissed without expressing any opinion on merits of the case with liberty to the applicants to approach the concerned Court of Sessions,” the Court ordered.
