Common intent

Section 149 of the IPC states: ‘…every person who, at the time of the committing of that offence, is a member of the same assembly, is guilty of that offence.’

New Delhi (ILNS): The Supreme Court has held that it is not necessary that before a person is convicted on the ground of common intention, he must be actively involved in the physical activity of assault.
