The Delhi High Court was informed by the Delhi Government and the Institute of Human Behaviour and Allied Sciences (IHBAS) that in case of another Covid-19 surge, it would increase the number of beds for Covid patients with neurological ailments. 

The bench of Justice Rekha Palli asked government counsel Gautam Narayan and IHBAS counsel Tuiushar Sannu if they were prepared for the much-feared third wave, they assured the Court that the number of existing beds would be increased from 60 to 80, which would be sufficient for Covid facility only for mentally ill patients/persons with neurological disorders.

Sannu told the Court that there was no need to increase the bed capacity as at present only 8 patients were in the Covid facility. The Court noted that the present petition was filed with a grievance that IHBAS, the second respondent, was not admitting Covid patients with neurological ailments. And in fact, the petitioner’s father who was already admitted to IHBAS was asked to leave upon testing Covid positive and told to shift into a covid facility. It appears during the pendency of present petition, the petitioner’s father was kept at IHBAS and given Covid treatment but unfortunately died.

“In view of these facts the court was constrained to direct IHBAS to create a Covid facility for Covid positive patients suffering from neurological ailments. And admit other Covid patients with neurological issues and not to discharge patients found Covid positive,” it noted.

Furthermore, the Court has noted that the respondents assured the court that the beds will be increased upto 80 beds when the cases arises. In view of this, the petition is disposed of.

As per previous orders dated May 13, the court had directed IHBAS and the Delhi government to place a status report and affidavit on record as to how the facility which has to be created for mentally ill patients/persons with neurological disorders is to be set up and what needs to be provided for the creation of such a facility.

ILNS: The Supreme Court administration on Thursday conveyed its ‘in-principle’ concurrence to the initiative of the Supreme Court Bar Association (SCBA) for setting up a temporary in-patient facility for Covid patients in the Supreme Court Complex.

The administration has made it clear that the staff of the Supreme Court Registry will not be associated with the proposed facility and it is for the Government of the National Capital Territory of Delhi to decide, as to how to operate the facility.

If the GNCTD, based on its own assessment, comes forward to set up the facility at the location proposed and as per the duly approved blueprint, the SC administration may consider handing over space to the concerned Authority of GNCTD, in accordance with the Covid protocol.
