The debate between personal liberty and national security concerns has been growing. In this context, the norms surrounding solitary confinement and speedy trial along with ensuring human dignity while being incarcerated need to be reemphasised.

The bench comprising Justices U.U. Lalit, Indira Banerjee and K.M. Joseph sought the NIA's response by March 15.

"We feel that with the condition of the under trial, it would be inappropriate to send him back (to jail). It would be appropriate to impose such conditions," the Bombay HC bench said.

Dr Varavara Rao is in Nanavati Hospital now after spending almost 3 years in Taloja Jail after his arrest in 2018 in the Elgar Parishad case, which is linked to the Bhima Koregaon case. He's a Telugu revolutionary poet of Marxist and Maoist ideologies.

Pendyala Hemlatha, wife of 81-year-old poet-activist Dr Varavara Rao, has moved the Bombay High Court seeking the release of her husband, an accused in the Bhima Koregaon violence case, on medical grounds.
