The Allahabad High Court while disposing the petition said that compassionate appointment can’t be denied where the in-service spouse had already retired prior to the death of the wife.

The three judge bench of Justices Ashok Bhushan, R Subhash Reddy and BR Gavai today dismissed a challenge of a Madras High Court order, upholding the demand of a senior government employee, Dr P Kirubarkan, for advance increment for his Ph D degree.
