The Division Bench of Chief Justice said that it shall not be appropriate to 'multiply litigation' by entertaining the present Petitioner since the case is already pending before a Division Bench at Lucknow which took suo moto cognizance of midnight cremation of the victim's body.
The division bench of Justices Pritinker Diwaker and PK Srivastava issued notices to the central government, the State of Uttar Pradesh, Superintendent of Jail (District Jail, Mathura), and Prabal Pratap Singh (Sub-Inspector, PS Maant, Mathura - the Informant/ Complainant).
The Allahabad High Court has directed the SSP of Prayagraj to provide security to the gang rape victim of Phoolpur and her family. At the same time, the court has directed the SSP to monitor the investigation of the case on its own and take strict action against the negligent police officers. The court has said that FIRs should be immediately registered for every criminal incident, especially crimes against women and children.
The Supreme Court today reserved its order on a batch of petitions in the alleged Hathras gang rape and murder case. The issues under consideration by the court are: who would monitor the CBI, if the case should be transferred and which agency will provide security.

SC today took serious note of the events in Hathras where a 19-year-old Dalit girl was gang-raped, tortured and then killed, allegedly by four upper caste men. Adding to her family’s woes, the UP police forcibly cremated her body in the dead of night. The top court termed these events as “shocking”.

Considering the medical report dated July 15, 2021 placed before the Court by Subham Tripathi, Counsel for King Georges Medical University, we allow termination of pregnancy of the victim, which shall be done at an authorised medical hospital within a period of one week," said the Court.
