Judges’ Appointments

The CJI has cleared the impression that “judges appoint judges in India” and said the selection process is very democratic. Nonetheless, the executive has often tried to interfere without much success.

In the Second Judges’case, it was observed that the president must act on the advice of the collegium in making judicial appointments. This shows the primacy of the judiciary over the executive in such matters.
