India has been struggling under the problem of huge arrears of pending cases for the past 70 years. A major shift needs to be made from adjourning authority to adjudicating authority and people should be made aware of Alternative Dispute Resolution systems
It is vital for any country governed by the rule of law that its judges decide cases solely on the evidence presented by parties and law. Judicial accountability vanishes when a judge travels beyond the case and makes unnecessary remarks in his decisions. This would set a precarious precedent and is undesirable.
The Supreme Court on Saturday allowed the applications of the Punjab and Haryana High Court and the Allahabad High Court to transfer of judicial officers/sessions court judges who are dealing with cases of prosecution of MPs or MLAs to other suitable posts.
