Juvenile Justice Act

The new Juvenile Justice (Care and Protection of Children) Amendment Bill, 2021, is a progressive legislation. The key changes brought to the juvenile laws reinforce the protection of children and also streamline the adoption system for juveniles.

The Rajasthan High Court has directed the state government to conduct training of Principal Magistrates in Juvenile Justice Boards for sensitising them with the JJ Act.

The High court held that the girl child was in need of care and protection , thus, the CWC acted upon within their domain and functions prescribed under Juvenile Justice Act and proceeded correctly by taking over the custody of minor girl child.

Amendments were recently introduced keeping in mind the sensitivity of issues pertaining to child protection and empowers DMs to coordinate and monitor agencies responsible for implementing the Act.

The state counsel opposed the petition, submitting that looking at the gravity of the case, the applicant is not entitled for grant of bail.

The petitioner AshwiniKumar Upadhyay had submitted before the court that there are severalacts that contain different provisions for adoption and guardianship, which areagainst gender equality, dignity of women and children. He sought removal ofsuch anomalies. 

The state follows others in setting up its first “Baal Mitra Police Thana” and as per the Juvenile Justice Act, has a separate room with bright colours and paintings in an effort to appear sensitive and approachable.

The Court allowed the petition on the ground of the woman being an adult and said, "the woman has the right to live her life on her own terms." The Court also quashed an FIR lodged against the couple in Kotwali Dehat Police Station of District Etah.

Justices L Nageswara Rao and Hemant Gupta heard the suo motu petition on the conditions of child protection homes across the country during the pandemic. The court said the Central government, through Solicitor General Tushar Mehta, had said children from protection homes shall not be sent back.....
