The Delhi High Court has granted bail to a man who was arrested by the Narcotics Control Bureau (NCB) for commission of offence punishable under Sections 8(c), 20 and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985.
The bench, comprising Justices Arun Mishra, Indira Banerjee, Vineet Saran, M R Shah and S. Ravindra Bhat observed: “Merely because the informant and the investigating officer is the same, it cannot be said that the investigation is biased and the trial is vitiated.”
The Kerala High Court while hearing an anticipatory bail petition, said that advance bail in a Narcotic Drugs and Psychotropic Substances Act, 1985 (NDPS) case could not be granted just because "nothing was recovered from the accused."
The erstwhile Municipal Corporation of Delhi, prior to its trifurcation, hired the respondents on a contractual basis. The respondents raised an industrial dispute for their regularisation and of which reference was made.
