The Supreme Court on Wednesday issued notice to the States of Gujarat, Tamil Nadu, Nagaland and Kerala for not appointing nodal officers in every district to curb incidents of mob violence and lynching

The Bench of Justice Sanjiv Khanna and Justice S.V. Bhatti passed the order on a batch of petitions concerning the incidences of hate speech across the country.

Earlier, the Apex Court had asked the Central government to file an affidavit regarding the States and Union Territories which have adhered to the Supreme Court directives laid out in the Tehseen Poonawalla case.

Additional Solicitor General K.M. Nataraj, appearing for the Centre, apprised the Bench that 28 States and Union Territories have appointed Nodal Counsels to tackle lynching and mob violence, besides procure intelligence reports pertaining to individuals likely to commit such crimes or engage in the dissemination of hate speeches.

The affidavit further gave details on which States or Union Territories were yet to comply with the directives.

The ASG submitted that on October 11, 2023, the Home Secretary had called a meeting of all States and Union territories, informing them about the steps to be taken regarding the Tehseen Poonawala directives. They were directed to file a compliance report in this connection, he added.

He said the States of Gujarat, Tamil Nadu, Kerala, West Bengal and Nagaland had not responded to the letter, adding that since these five states have not responded to their letter, the government did not know whether they had appointed the Nodal Counsel or not.

The Counsel appearing for the West Bengal government said that the State has duly adhered to the directions and appointed the Nodal counsel.

The Court then issued notice to the four states and listed the matter for further hearing on February 5.

ILNS: The Supreme Court bench of Justices L. While funds would be available from PM CARES fund and other sources, the first duty of Amicus Curiae Advocate Gaurav Agarwal will be to have a list of children who have either lost both their parents or one parent (the bread-winner of the family). The number at the moment is 9,436, but this is not final. To do this, the Amicus will have to get help from the nodal officers. Other states will be taken into the picture in the second stage.

In its previous hearing the bench had directed the district administrations of all states to take charge of children orphaned due to the Covid19 pandemic after March 2020. The Court had the children’s basic needs should be attended to while further orders are passed.

The bench said: “We assume that breadwinners are dead.

Agarwal: “The PM CARES has come up with a scheme to grant aid to children who have lost their parents. (Reading about the scheme) It will continue the education of children, financial help for children for higher education, health insurance till 18 years. How is the GoI going to implement this scheme? How is this going to happen? There may be some suggestion from Additional Solicitor General Aishwarya Bhati.

The bench asked: “You want a nodal officers to be appointed?”

Agarwal: “We want five southern states and five northern states (where this has to happen first). They are Gujarat, Rajasthan, UP, Jharkhand Maharashtra Bihar, Telangana, Andhra Pradesh, Tamil Nadu and Kerala.”

Bench: “We will have it next Monday.”

ASG Aishwarya Bhati: “The modalities of the PM CARES facilities have to be worked out.”

Bench: “We will appoint a Nodal Officer who will communicate with the Amicus on how all schemes are going to be implemented. We need the exact data of children who have become orphaned. Ten states are going to appoint nodal officers. Initially 10 states, but we won’t stop at 10.  We will take two-states per day.”

Advocate Swarupama Chaturvedi for NCPCR: “On data about children who have lost their parents, please give us time for verifying and uploading the data. Every day we are getting information.”

Bench: “We will do that. We will direct the states governments to continue uploading information about the orphans.”

NCPCR: “May this order record both children who have lost both parents and also either of the parents.”

Bench: “Children who have lost either of their parents should be considered Children in Need of Care and Protection (CNCP).”

The order of the bench was as follows:

“As per the previous orders we have directed to upload the information of Children who become orphaned after March 2020.  We have directed the state authorities to take care of the basic needs of those children. The NCPCR filed an affidavit in which it shows the data of Children who have lost either of the parents and both the parents. At present there are 9,436 children who have lost parents.

“NCPCR counsel submits that States have not been able to provide the complete information regarding the children who have been affected during the pandemic. Time given to district authorities is extended in these circumstances.

“Mr Sachin Patil for Maharashtra and Manish Singhvi for Rajasthan submitted that district authorities are finding it difficult to upload the data.

“The learned amicus apprised us about the scheme announced by the PM. The PM CARES for Children: Empowerment of COVID affected Children launched for support and empowerment of Covid affected Children. The Particulars of the scheme are not available. The UOI shall also furnish details about the mechanism which would be adopted for monitoring the scheme.

The Patna High Court has asked the State Government to consider appointing a Nodal Officer to help contain the COVID-19 pandemic accordingly as advised by the NITI Aayog, while stating the role of Civil Society in the form of individuals, CSOs or NGOs, in helping the orphans, elderly persons, and specially challenged persons, cannot be undermined.

A two-judge Bench led by the Chief Justice Sanjay Karol and Justice S. Kumar was hearing a petition seeking directions to the State Government to follow the guidelines issued by the NITI Aayog to allow the civil society to work with the administration of the State and provide assistance to people in form of food and shelter during the current times of a pandemic. While the petitioner Advocate Parul Prasad appeared as petitioner-in-person, Additional Solicitor General Senior SD Sanjay appeared for the Centre and Advocate PN Shahi appeared for the state.

The Court observed that this Country is not unknown to public and private participation of people to overcome natural disasters and adversities. It is important to remember significance of the Directive Principles of State Policy and Fundamental Duties while fighting against a Corona virus pandemic.

The Court has asked the State to consider constituting a Nodal Officer according to the letter issued by NITI Aayog, making the following suggestions:

·             The officer who has already been appointed under the Bihar Epidemic Diseases COVID-19 Regulations, 2020 may be authorized as the Nodal Officer.

·             Technology can be used for centralized monitoring of the problems faced, the relief provided, and the action taken.

·             A website, to be operated at the level of the Government of Bihar can be opened up where any member of the Society wanting to help the Government can register their request and the same can be dealt with promptly by a duly authorized competent and  responsible officer.

·             The modalities are left open to be determined by the State.
