Section 66A of the IT Act

The Supreme Court on Monday issued notice to all states and Union Territories (UTs) on a petition, seeking direction to the Centre to advise all police stations against registering FIRs under Section 66A, which was declared unconstitutional by the top court on March 24, 2015.

The apex court began hearing in the plea filed by NGO People's Union for Civil Liberties (PUCL), alleging that despite the Court's February, 2019 order, Section 66A of the Information Technology Act continues to be used in police stations as well as in trial courts across the country

Orders of the apex court are often flouted and some 1,000 cases have been filed under Section 67A of the IT Act, which was declared illegal. The Court has asked the centre to explain this brazen disregard.
