Senior Citizens Act

A senior citizen, a woman, filed a complaint in the Delhi High Court under the Maintenance and Welfare of Parents and Senior Citizens Act for eviction of her son and daughter-in-law from the premises. The verdict could be a legal landmark for others in similar situations

The amendment of the Domestic Violence Act, in 2016 was brought to the picture in the context, but that did not deter the top court in passing the judgment.

The petitioner's counsel submitted that the mother already had sufficient income on her own and hence, the award of the said maintenance was not in terms of the provisions of the Act

The Supreme Court has held that, the right of a wife to a shared household under the Domestic Violence Act will prevail against a decree obtained by her aged in-laws under the Senior Citizens Act.
