Having heard the counsel for the parties and on perusal of the record, Calcutta High Court noted that earlier also the petitioner had filed Petition which was disposed of by the Division Bench of the Court vide order dated 18th April 2019 by holding as under:

Delhi High Court division bench while dealing with a plea alleging doctors’ strike to be morally, ethically and legally wrong for it disrupts regular hospital services bringing endless pain, suffering and death to the defenseless patients, expressed disinclination to issue notice in the matter. 

The Delhi High Court division bench issued notice in an appeal preferred by the NBE challenging the decision of single-bench of Justice Prateek Jalan, passed on July 5, 2021.
