Former BJP MP and actor Jaya Prada on Monday surrendered before the MP/MLA Court in Rampur, days after she was considered ‘absconding’ in two cases related to the alleged violation of the Model Code of Conduct.

As per Senior Prosecution Officer Amarnath Tiwari, two cases had been registered against the BJP leader at the police stations of Kemri and Swar over alleged violation of the Model Code of Conduct during the 2019 elections.

The MP/MLA court in Rampur had issued CrPC order 82 for non-appearance of the yesteryear actor on February 27.

Earlier, the court had issued non-bailable warrant (NBW) seven times against Jatya Prada, but police could not produce her before the court.

In its reply filed before the court, the Uttar Pradesh Police said that Jaya Prada was evading arrest and all her known mobile numbers were switched off.

Judge Shobhit Bansal then declared Jaya Prada an absconder and directed the police to arrest her and produce her before it on March 6.

The Superintendent of Police of Rampur was ordered to form a team under the leadership of a circle officer and arrest Jaya Prada and produce her in the court on the next date of hearing on March 6.

Jaya fought the 2019 elections from Rampur seat on a BJP ticket. She was defeated by Azam Khan of the Samajwadi Party.

She was elected to the Lok Sabha from Rampur in 2004 and 2009 on a Samajwadi Party ticket. Later, she joined BJP after the Samajwadi Party expelled her.

The Supreme Court has been approached by Govindhbhai Nai,who is one of the convicts in the Bilkis Bano gang rape case, for seeking four weeks time to surrender before the concerned jail authorities.

On January 8,the Apex Court ordered Nai and ten other convicts to surrender before the jail authorities within two weeks of time.

In his apeal Nai has asked for extension in surrendering before the court stating his ill health. The convict has also requested the court about his responsibilities at domestic end for which he needs some time.

As per the plea, Nai’s father is bedridden and dependent on him. 

He has further submitted that he had to undergo an angiography recently and is yet to undergo another operation for the treatment ‘Hemorrhoids’.

The eleven convicts (respondents) before the top court had been convicted for raping Bilkis Bano and murdering her family members during the Gujarat riots of 2002.

The Gujarat government granted the remission of their sentence following a May 2022 judgment in which the top court held that an application of remission should be considered in line with the policy of the State where the crime was committed (Gujarat, in this case) and not where the trial was held.

The Gujarat government’s decision was challenged by various petitioners including Bano before the top court.

The Supreme Court bench of Justices BV Nagarathna and Ujjal Bhuyan on January 8 quashed the remission granted to them by the Gujarat government. It concluded that the Gujarat government had no power to apply its remission policy to these eleven convicts.

It, therefore, directed all eleven to surrender within two weeks.

Ashish Mishra, son of Union Minister Ajay Mishra ‘Teni’ and prime accused in the Lakhimpur Kheri violence case, has finally surrendered before the Magistrate at the district jail.

Ashish surrendered on April 24, almost a week after the Supreme Court cancelled his bail and asked him to surrender.

The top court had set aside the Allahabad High Court order dated February 10, 2022, and had remit the matter back to the High Court.

It said the order of the Allahabad High Court cannot be sustained and has to be set aside and bail bonds of the respondent/accused are cancelled.

The Court clarified that it has not expressed any opinion, either on facts or merits.

“All questions of law are left open for the High Court to consider and decide.” Eight people, including four farmers, were killed in the incident that took place on October 3, 2021.

Ashish is said to have run over the farmers, who were protesting against the three farm bills that the Centre had introduced in September, 2020.

In the above case, he was arrested on October 9, but was later granted bail in February, 2022.

The court had given him, bail but the family members of the victims moved the Supreme Court, challenging the Allahabad High Court order, which granted bail to Ashish.

The Supreme Court had earlier appointed a committee headed by retired Punjab and Haryana high court judge Rakesh Kumar Jain to monitor the probe into the Lakhimpur Kheri violence.

The Supreme Court on Friday asked the State of Kerala to not insist the prisoners already released on interim bail or parole to surrender when the State is witnessing a surge in the cases of Covid-19. 

A Bench comprising Justice L Nageswara Rao and Justice BR Gavai passed the order on  a batch of petitions filed against the State of Kerala for insisting prisoners, who were released by the State Government on parole or interim bail in the wake of Covid-19, to surrender. 

The Court asked the State of Kerala to examine the Covid-19 situation in the jail and consider releasing the prisoners who are still in prison, for the time being.
The Apex Court, in  a suo motu writ petition, was considering the issue of overcrowding in prisons, especially in the wake of the pandemic and issued notice to the concerned State authorities to show cause as to why directions should not be issued for dealing with the health crisis arising out of Covid-19 in the prisons.
On March 23, 2020, the Apex Court had directed the States/Union Territories to constitute a High-Powered Committee to determine which class of prisoners can be released on parole or interim bail. After overall scrutiny the committee was to determine the category of prisoners who could be released.

Senior Advocate, P.V. Surendranath, appearing on behalf of the State of Kerala, assured the Bench to consider the suggestions put forth by it, but he protested the allegation that the directions to surrender were issued in the teeth of the orders of the Apex court.

The matter will be considered after two weeks.

New Delhi: Gopal Saini, one of the accused and one of dead gangster Vikas Dubey’s key aide, absconding from the July 3 killing of eight policemen Kanpur, has surrendered at the Mati district court of Kanpur, it was learnt.

During the shootout, apart from the other seven policemen, a deputy superintendent of police was also killed.

The manhunt ended in Dubey ‘surrendering’ in Ujjain, Madhya Pradesh, but being later gunned down in an ‘encounter’ with UP police after MP Police had transferred the gangster to them. This ‘encounter’ will now be investigated by a three-man commission set up by the Supreme Court.
