The government asked the Apex Court as to why did the High Court order the investigation from CBI when in it has only been ordered to investigate when there is the involvement of State police in the crime and not otherwise.

Senior Advocate Dushyant Dave termed the consequences of transferring the case to CBI which is under BJP’s control as serious.

Dave told the bench by Justice BR Gavai that the order “goes to the heart of democracy.”

He said that in case of CBI being allowed to investigate, it would call for a grave miscarriage of justice.

He quoted that BJP itself, at two stages, said that they don’t want CBI investigation. There is a record of it. There was also no evidence that SIT investigation was interfered with in any way. I respectfully submit that this matter should be finally heard. It’s very serious. Goes to the heart of democracy.

The counsel said that BJP is in power at the Centre, it is accused. How can CBI investigate?He further questioned on how is it assumed the interference by CM in the investigation?

Dave said that there is a conspiracy to bring down their government by illegal means. He questioned the intentions stating that holding a press conference cannot interfere with investigations.

The advocate also said that allegations need to be substantiated on rational grounds. He added that they are a regional party, and BJP is a national party trying to destabilise. All members of opposition party are in jail

The Telangana High Court has ordered that the special investigation team (SIT) appointed by the Telangana government to investigate the alleged attempts made by BJP to poach four Legislators of the ruling TRS, will report to Justice B Vijaysen Reddy.

The Bench of Chief Justice Ujjal Bhuyan and Justice C.V. Bhaskar Reddy directed the SIT on Tuesday not to report to any political or executive authority, but to a Single-Judge Bench of the High Court.

The seven-member team, headed by Hyderabad Police Commissioner C.V. Anand, will be supervised by Justice B Vijaysen Reddy.

The Bench had yesterday passed a slew of directions for an independent SIT probe along with liberty to approach a Single-Judge Bench for further permissions required, if any, for investigation.

The High Court further directed the authorities to refrain from interfering in the investigation by the SIT.

It observed that considering the political sensitivity of the case, it was important that the probe was conducted in a fair and professional manner, away from any political influence.

The Bench further directed against selective leakage of investigation or material gathered during investigation, while asking Hyderabad Police Commissioner CV Anand, who is also the Chairman of SIT, to ensure that the directions issued by the High Court were followed scrupulously.

The High Court noted that Justice Reddy, who had been hearing petitions related to the case, shall monitor the investigation and pass orders on the basis of materials, including the progress of investigation to be submitted before him in sealed cover by the SIT from time to time.

The first report regarding the progress of investigation will be submitted by SIT in a sealed cover to Justice Reddy on November 29, it added.
Other members of the SIT include Rama Rajeshwari, IPS, SP, Nalgonda; Kalmeshwar Shingenavar, IPS, DCP, Crimes, Cyberabad; R.Jagadishwar Reddy, DCP, Shamshabad, Cyberabad; N.Venkateshwarlu, SP, Narayanpet; B.Gangadhar, ACP, Rajendranagar Division, Cyberabad; and Laxmi Reddy, SHO, Moinabad Police Station, Cyberabad.

A petition was filed by the state unit of Bharatiya Janata Party (BJP), challenging the Single-Judge Bench order passed by Justice B. Vijaysen Reddy on November 8, lifting the stay on probe by the State Police into the poaching allegations by TRS.
A first information report (FIR) in the case was lodged by the respondent for criminal conspiracy and other sections under the Indian Penal Code (IPC) as well as under Section 8 of the Prevention of Corruption Act.

The Supreme Court on Friday adjourned hearing to November 7, in the bail petition filed by three people, who were arrested by Cyberabad Police in Telangana on October 26, while allegedly attempting to persuade four MLAs of the ruling Telangana Rashtra Samithi (TRS) to join BJP, in lieu of Rs 100 crore.

The Bench headed by Justice B.R. Gavai issued notice on the bail pleas of Ramachandra Bharati, Simhayaji and Nanda Kumar, who were alleged of having links with BJP. 

The Apex Court told the accused that the Trial Court would hear their bail petition on the basis of merit and assured them that hearing in the lower court would not be affect their case pending before the High Court.

Cyberabad police of Hyderabad had arrested the accused from a farmhouse at Moinabad near Hyderabad on the night of October 26, when they were allegedly trying to bribe four MLAs of TRS. 

They were booked under various Sections of the Indian Penal Code (IPC) and the Prevention of Corruption Act.

The accused were produced before a Magistrate on the night of October 27, but he refused to send them to judicial custody, citing lack of evidence.

Following the court orders, police released the accused. Later, police approached the Telangana High Court challenging the orders of the lower court.

On October 29, Cyberabad police re-arrested the accused, after the Telangana High Court set aside the lower court’s order to release them.

The accused were taken to Cyberabad Police Commissionerate and from there to Moinabad police station.
