A National Investigation Agency court on Thursday discharged Assam MLA Akhil Gogoi in the only pending UAPA and sedition case against him. He is clear of all charges and likely to walk out of jail soon, his lawyer said.
Gulfisha Fatima has been charged under various sections of UAPA for being involved in the riots that happened in the North East Delhi. It is alleged that she was part of a larger conspiracy behind inciting the Northeast Delhi Riots that took place in February 2020.
The accused have been in jail since October 7 last year in another case under Sections 153A (promoting enmity between groups), 295A (outraging religious feelings), 124A (sedition), 120B (conspiracy) of IPC, 17/18 of UAPA (raising funds for terrorist act) and under the IT Act.
The two have been held in a case related to a larger conspiracy in the Northeast Delhi riots in February last year. The Court deferred the hearing on Tuesday, after want of verification of their addresses.
The Supreme Court on Friday dismissed a bail application filed by an accused, who was convicted for storing ammunition and fake Indian currency, in addition to making a team for terrorist training in Pakistan.
Solicitor General Tushar Mehta submitted, “I have a preliminary objection, that one person is in jail and a charge sheet has been filed against him under the UAPA. Eight persons filed for bail and a journalists’ association file a Habeas Corpus petition, which is not maintainable.
