The Special Investigation Team of the Uttar Pradesh Police has said in its report that the killing of farmers during a procession in Lakhimpur Kheri on October 3 was a planned conspiracy in its submission before a Lakhimpur court.

The SIT is probing the Lakhimpur Kheri violence in which Union MoS Ajay Mishra Teni’s jailed son Ashish Mishra is the main accused among 13 others. Further, the SIT has written the court to modify charges against the accused, including Ashish Misra.

In the application, investigating officer Vidya Ram Diwakar stated that the act wasn’t a negligent act committed by the accused but it appeared from the probe that had been conducted and material collected so far that it was done intentionally as per the premeditated plan to kill.

In the application, the SIT has also asked the court to register accused in additional sections of the Indian Penal Code including 304A (culpable homicide not amounting to murder), 279 (negligent driving), and 338 (causing grievous hurt) against all accused be removed and instead, Sections 307 (attempt to murder), 326 (causing hurt with dangerous weapon), 34 (acts done by several persons in furtherance of common intention), and 3/25 Arms Act be registered against them.

The SIT has also requested the court to drop three charges against the accused, namely IPC sections 279 (rash driving or riding on a public way), 338 (causing grievous hurt by act endangering life or personal safety of others), and 304a (causing death by negligence).

The SIT on Monday moved an application in the Lakhimpur court stating that during the course of the investigation they found new evidence and sought to invoke new sections of the Indian Penal Code.

The incident happened on October 3 when a convoy of three SUVs, including a Mahindra Thar belonging to Ajay Mishra, mowed down farmers who were agitating against the Centre’s three farm laws, in which one journalist, two BJP workers, a driver in the employ of Ajay Mishra were also killed in the ensuing violence.
