The Apex Court has put stay in an order on friday which was passed by the High Court of Calcutta directing the CBI to investigate as to who was the mastermind behind the application filed by the West Bengal School Service Commission for saving services from illegally appointed candidates.

A bench by Chief Justice of India DY Chandrachud stayed the order by the High Court’s order- which has also directed the personal appearance of the Principal Secretary of West Bengal Education Department Manish Jain.

Dr Abhishek Manu Singhvi, who appeared for the State, said that altough the petition is not listed for te day but he wants urgent intervention as the Secretary of the Education Department has been summoned by the High Court for examination.

The senior counsel said that the single bench of High Court observed that the Commission has filed the application as a “benami” for someone and thus directed for probe by CBI.

The single bench did not permit when the Commission when it sought liberty to withdraw the petition, and ordered CBI probe to find out where the application originated from.

The single bench of Justice Abhijit Gangopadhy, who is hearing cases related to the SSC recruitment scam, passed the order.

The agency was asked to file a report within seven days regarding the same.

The SSC had filed the application to regularize the services of candidates, whose appointments were invalidated following the Court directions in relation to the recruitment scam.

Although intra-court appeals,were filed by the State and the SSC , the division bench of Justices Subrata Talukdar and Supratim Bhattacharya refused to stay the single bench order.

In this background, the State rushed to the Supreme Court.

The bench comprising CJI DY Chandrachud and Justice Hima Kohli when approached today, in the matter ordered that pending further orders, order of single judge dated November 23 shall remain stayed.

It also instructed that no consequential steps will be taken in pursuance of single judge order including the CBI probe into who filed affidavit.
