New Delhi (ILNS):<\/strong> In a 150-page judgment, the Supreme Court<\/a> has ruled that the wife has the right of residence in the shared family property and not just in the separate property of the husband.\u00a0This is a verdict under the Domestic Violence Act.<\/p>\n\n\n\n

A three-judge bench headed by Justice Ashok Bhushan overturned the decision of a two-judge bench in the Tarun Batra case and said that \u201cdomestic\u00a0violence\u00a0in\u00a0this\u00a0country\u00a0is\u00a0rampant and several\u00a0women\u00a0encounter\u00a0violence\u00a0in\u00a0some\u00a0form\u00a0or the\u00a0other\u00a0almost\u00a0every\u00a0day.This is\u00a0the\u00a0least reported\u00a0form\u00a0of\u00a0cruel\u00a0behavior.\u00a0A\u00a0woman\u00a0resigns\u00a0to her fate\u00a0in the never ending\u00a0cycle\u00a0of\u00a0enduring\u00a0violence\u00a0and discrimination\u00a0as\u00a0a\u00a0daughter,\u00a0a\u00a0sister,\u00a0a\u00a0wife,\u00a0a mother,a\u00a0 partner\u00a0or a\u00a0single\u00a0woman\u00a0in\u00a0her\u00a0lifetime.<\/p>\n\n\n\n

\u201cThis\u00a0non-retaliation\u00a0by\u00a0women, coupled\u00a0with\u00a0the\u00a0absence of\u00a0laws\u00a0addressing\u00a0women\u2019s\u00a0issues,\u00a0 ignorance\u00a0of\u00a0the existing\u00a0laws\u00a0enacted\u00a0for\u00a0women and\u00a0societal\u00a0attitude makes\u00a0women\u00a0 vulnerable.\u00a0The\u00a0reason\u00a0why most\u00a0cases of\u00a0domestic\u00a0violence\u00a0are\u00a0never\u00a0reported\u00a0is\u00a0due\u00a0to\u00a0the social\u00a0stigma\u00a0of\u00a0the\u00a0society and\u00a0the\u00a0attitude of the women\u00a0themselves,\u00a0where\u00a0women\u00a0are\u00a0 expected\u00a0to\u00a0be subservient,\u00a0not just\u00a0to\u00a0their\u00a0male\u00a0counterparts\u00a0but also to the male\u2019s relatives.\u201d<\/span><\/p><\/blockquote>\n\n\n\n

The judgment was given in an appeal filed by Satish Chander Ahuja, questioning the judgment of the Delhi High Court dated 18.12.2019 in RFA No.381\/2019 by which judgment the Delhi High Court set aside the decree granted in favour of the plaintiff dated 08.04.2019 under Order XII Rule 6 of Civil Procedure Code, decreeing the suit filed by the plaintiff for mandatory and permanent injunction.<\/p>\n\n\n\n

The High Court after setting aside the decree of the Trial Court has remanded the matter back to the Trial Court for fresh adjudication in accordance with the directions given by the High Court. The plaintiff aggrieved by the judgment of the High Court<\/a> has come up in this appeal.<\/p>\n\n\n\n

This appeal raises important questions of law pertaining to the interpretation and working of the Protection of Women from Domestic Violence Act, 2005.<\/p>\n\n\n\n

The plaintiff has pleaded that the wife of the plaintiff has been subjected to various threats and violence in the hands of the defendant on several occasions. In the event, the suit is filed by the wife of the plaintiff against the defendant for permanent injection and also praying for reliefs under Section 19[except Section 19(1)(b)].<\/p>\n\n\n\n

Earlier in the Tarun Batra case, a two-judge bench had said that the daughter-in-law, in law, cannot live in the property owned by her husband’s parents.<\/p>\n\n\n\n
