{"id":148324,"date":"2021-03-19T14:33:48","date_gmt":"2021-03-19T09:03:48","guid":{"rendered":"https:\/\/www.indialegallive.com\/?p=148324"},"modified":"2021-03-19T18:09:05","modified_gmt":"2021-03-19T12:39:05","slug":"delhi-high-court-it-rules-2021","status":"publish","type":"post","link":"https:\/\/www.indialegallive.com\/constitutional-law-news\/courts-news\/delhi-high-court-it-rules-2021\/","title":{"rendered":"Delhi High Court issues notice on plea seeking striking down of IT Rules, 2021"},"content":{"rendered":"\n<p>The <strong><a href=\"https:\/\/www.indialegallive.com\/delhi-high-court\/\">Delhi High Court<\/a><\/strong> on Wednesday issued notice on writ filed by an Advocate challenging the legality and constitutionality of the newly introduced Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.<\/p>\n\n\n\n<p>A divisional bench of Chief Justice D.N. Patel and Justice Jasmeet Singh has sought responses from the Central Government, Ministry of Electronics and Information Technology, Ministry of Information and Broadcasting and Ministry of Law and Justice.<\/p>\n\n\n\n<p>The petition has been filed by practicing Advocate, Sanjay Kumar Singh, alleging, \u201c\u2026impugned rules significantly intrude and unconstitutionally restrict petitioner\u2019s freedom of speech and expression in so far as posting content on social media platforms is concerned.\u201d<\/p>\n\n\n\n<p>Singh has sought direction declaring Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 as unconstitutional and the same be struck down.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote td_quote_box td_box_center\"><p><span class=\"has-inline-color has-vivid-red-color\">The petition submits, \u201c\u2026the rules banning postings, publishing or sharing of content on the platform of the intermediary on certain grounds are far too overbroad without the necessary explanations, exceptions or clarifications.
