The Lucknow Bench of the Allahabad High Court has allowed the bail application of a minor accused of posting comments against Goddess Durga on his Facebook Account.<\/p>\n\n\n\n
A Single Bench of Justice Subhash Vidyarthi passed this order while hearing a Criminal Misc Bail Application filed by a minor.<\/p>\n\n\n\n
By means of the application the applicant seeks bail in Case under Sections 298, 505(i)(c), I.P.C, and Section 67, Information Technology Act, P.S Pura Kalandar, District Faizabad.<\/p>\n\n\n\n
The aforesaid case has been registered on the basis of an F.I.R lodged on 27.09.2022, stating that the applicant was posting comments against a Goddess on his Facebook Account.<\/p>\n\n\n\n
A supplementary-affidavit has been filed on behalf of the applicant annexing therewith a photocopy of his High School Certificate-cum-Marksheet, which mentions his date of birth to be 07.01.2006 and a copy of his Adhar-card, wherein the same date of birth is mentioned.<\/p>\n\n\n\n
From the Aadhar-card and High School Marks-sheet of the applicant, it clearly appears that the applicant is a minor and yet he is languishing in jail since 27.09.2022., the Court observed while allowing the bail application.<\/p>\n\n\n\n
“Let the applicant be released on bail in the aforesaid Case under Sections 298, 505(i)(c), I.P.C, and Section 67, Information Technology Act, P.S Pura Kalandar, District Faizabad, on submission of a personal bond and two sureties, each in the like amount, by his guardian, to the satisfaction of Magistrate\/Court concerned”, the Court ordered.<\/p>\n","protected":false},"excerpt":{"rendered":"
