Uniform Civil Code: Supreme Court disposes of plea seeking implementation

The Supreme Court on Friday dismissed a petition as withdrawn, seeking implementation of the Uniform Civil Code (UCC).

The Bench headed by Chief Justice of India (CJI) U.U. Lalit observed that some petitions were already pending on the matter.

As per the Counsel, the question was that personal laws were included under the ambit of Article 13 of the Indian Constitution. The Law Commission has said that UCC was not desirable.

The CJI refused to exercise its writ jurisdiction over the petition that sought mandamus on a law to be enacted in a certain fashion.

Stating that petition was very well-researched and drafted perfectly, the Apex Court observed that it cannot grant to the petitioner.

After the Advocate for the petitioner contended that benefits on the basis of religion were violative of Article 14 as secularism was part of the basic structure, the top court of the country told him to withdraw the plea or the same will be dismissed.

The Apex Court observed that the plea may be correct on that The State Of Bombay vs Narasu Appa Mali needs reconsideration. However, nothing can be done here as the judgment was doubted on two occasions by this court, noted the CJI.

The Counsel then sought permission to withdraw the petition.

The CJI gave permitted him permission and disposed the same as withdrawn.
