All India Muslim Personal Law Board (AIMPLB) on Monday moved an impleadment plea in the Supreme Court in a PIL challenging validity of polygamy and nikah halala practised among Muslims.

In the impleadment plea, AIMPLB said that religious practices of one religion should not be allowed to be examined by someone from a different religion.

The muslim body opposed Uniform Civil Code and said that Article 44 of Indian Constitution, which discusses having a common law for the entire nation, was “only a directive principle of state policy and is not enforceable”.

The plea further highlighted that the Islamic law is based on Holy Quran and Hadith and its legality can’t be validated on a challenge based on fundamental rights.

The impleadment plea has been filed in a PIL that challenged the legality of polygamy and nikah halala among Muslims.

It further said in the plea that the apex court has already addressed the issue of polygamy in 1997 and refused to pass any order at that time.

The Muslim board also urged the apex court that they should be permitted to argue when the PIL’s comes up for hearing.
