#Bombay HC to examine a report from CBI

The Bombay HC is likely to examine a report on September 1 from CBI. The HC had ordered for the report on the previous hearing. The Court had asked the CBI to file the report on the findings of JA Patil commission report.

#Supreme Court to hear a case regarding entry tax

The Supreme Court on August 31 will hear petitions challenging the constitutionality of entry tax in various states in India. The court will hear over 2,000 cases filed by manufacturers and associations challenging the levy of entry tax by various states. 

#Apex court to hear PIL concerning disabled people

The apex court will hear a PIL on August 31 concerning the rights of disabled people. The court had earlier directed the Centre, state government and Union territories to implement the provisions of Persons with Disabilities Act, 1995.

#Supreme Court to hear a review petition

The Supreme Court will hear a review petition on August 31 from a death penalty convict. The petitioner has been convicted for raping four-year-old girl. The petitioner had approached the apex court after the death sentence awarded by a Nagpur court. It was also confirmed by the High Court. However, the apex court dismissed his appeal and maintained the death sentence.

#Petitions involving Kanhaiya Kumar to be heard

The Supreme Court will hear a bunch of petitions on August 31 filed during JNU/Kanhaiya Kumar fiasco. First petition is with regard to protection of Kanhaiya Kumar and others accused in the sedition case. Second petition is a contempt petition filed against four lawyers for taking actions disrespecting the orders of the apex court.

#Top court of UP to hear a case against Google

The Allahabad High Court will hear a petition on August 31 on the notice issued to Google. The notice was issued for not removing the name of PM Modi who has been listed as the top 10 most wanted criminals. The CEO of Google and Chairman of Google India were asked to be present in the Court.

#Allahabad HC adjourns case regarding teachers salary

The Allahabad High Court on August 30 adjourned a case related to the suspended teachers salary in Uttar Pradesh. The Court asked the basic educational secretary of UP to present the report on the issue till October 3. The Court had dismissed the appointment of the teachers in 2009.

#Construction of PHCs in UP ordered

The Lucknow bench of Allahabad High Court on August 30 ordered the UP government to make primary health centre (PHC) in Ballarpur village, Bangarmau Tehsil. The Court directed to construct PHCs in 30 villages located between Ganga and Kalyani rivers within four months.

#Local court indicts in Shramjeevi Express Bomb blast case

A local court in Uttar Pradesh convicted Obaidur Rehman, a resident of Bangladesh in Shramjeevi Express Bomb blast case. The court will pronounce quantum of punishment on August 31. The Court had already pronounced sentence to Alamgir, one of the co-accused. The case had witnessed the conviction of seven people. Shramjeevi Express Bomb blast incident had happened in 2005 in which 12 people lost their lives.

#Delhi HC adjourns case involving Himachal CM

The Delhi High Court on August 30 adjourned the hearing of a case regarding disproportionate assets involving Himachal CM Virbhadra Singh to September 1. The Court said that the case would be presented before another bench without citing any reason for the same. In the last hearing, CBI had stated that the
charge sheet against Singh was ready to be filed in the case.

#Bombay HC lambasts Railways for inadequate infrastructure

The Bombay High Court on August 30 adjourned the hearing of a case regarding poor facilities at the railway stations. The Court deferred the matter to September 13. While hearing a bunch of PILs related to infrastructure issues, the Court asked central railway and western railway questions pertaining the issue. The Court asked both railways bodies as why they don’t want to be audited by a central agency. The Court directed the general manager of central and western railway to give an undertaking. The undertaking should state that the petitioner will visit the stations and point out infrastructural deficiencies, the Court said. The counsel for railway sought time for taking instructions.

The Court said since 2011 whatever you have done only when we passed the order. You have not done anything on your own. If you will not give consent to audit your work, the Court will appoint its own officer for that and a contempt notice will be issued against you, the Court said.

#Supreme Court: Throwing money on women in dance bars is indecent

The Supreme Court on August 30 objected to the act of throwing money at women in Maharashtra’s dance bars. “Even if the performer does not find such an act objectionable, throwing money at dancers affects the dignity of the women,” the Court pointed out. The Court was hearing a petition challenging the Constitutional validity of certain provisions in Maharashtra Police (second amendment) Act which bans dance performances at bars and hotels in Maharashtra.

#Kerala HC orders probe into an Islamic educational institution

The Kerala High Court recently ordered an enquiry into the background of a Muslim educational and charitable organization known as Sathya Sarani in Malappuram district while hearing a plea. The plea which was filed by a retired army man alleged that this organization was an Islamic conversion center. And that this institution illegally confined her daughter and it was also planning to send her daughter to Syria.

#EC indicts Apple and Ireland for undue tax benefits

The European Commission (EC) on August 30 concluded that Ireland granted undue tax benefits of up to €13 billion to Apple. This is illegal under EU state aid rules, because it allowed Apple to pay substantially less tax than other businesses. Ireland must now recover the illegal aid, the EC said. The EC said “Following an in-depth state aid investigation launched in June 2014, the European Commission has concluded that two tax rulings issued by Ireland to Apple have substantially and artificially lowered the tax paid by Apple in Ireland since 1991”.

#Allahabad HC to hear case pertaining Jawahar Bagh incident

The Allahabad High Court will hear a matter on August 30 related to CBI investigation in Jawahar Bagh incident. Two police officers including 29 others were killed in this incident. The petition was filed by the BJP leader Ashwani Updhayay.

#Top court of UP to hear a case against Google

The Allahabad High Court will hear a petition on August 30 on the notice issued to the search engine Google. The notice was issued for not removing the name of PM Modi who has been listed as the top 10 most wanted criminals. The CEO of Google and Chairman of Google India were asked to present in the Court.

A CBI court will hear a matter on Dera Saccha Sauda chief, Gurmeet Ram Rahim. Rahim has been charged  in the sexual harrasment case.

#Bombay HC to seek response on lack of infrastructure at courts

The Bombay High Court on August 30 is likely to seek response from the Maharashtra government. The government will submit response on the Registrar General’s (Bombay High Court) report on the lack of essential infrastructure in the courts of Maharashtra. The Court had taken suo moto cognizance of the said report and sought response from the Government.

#BMC’s former commissioner case to come up

The top court of Maharashtra will hear a petition on August 30 filed by former Brihanmumbai Municipal Corporation Commissioner. The Commissioner was booked under section 304 of IPC for a building collapse during his tenure. According to the petitioner, he was charged for the crime without any sanction from the authority. The petitioner has challenged the said process in the petition.

#Bombay HC to hear a PIL on acid attack victim  

The Bombay High Court will hear a petition on August 30 related to an acid attack victim. The petition seeks an implementation of a scheme compensating the victim.

#Apex court to hear PIL regarding prisoners

The Supreme Court will hear a PIL on August 30 relating to the prevalent in-human conditions in prisons in the country. #Nupur Talwar gets parole to visit ailing mother

Nupur Talwar, a convict in the murder of her daughter, Aarushi Talwar was granted parole for three weeks by Allahabad High Court on August 29. The parole has been granted to Nupur Talwar to visit her ailing mother. Nupur along with her husband Rajesh were found guilty of killing her only daughter Aarushi by the CBI court in 2013.

#Apex court allows Asaram to travel for medical supervision

The apex court on August 29 permitted Asaram Bapu to be examined in All India Institute of Medical Sciences (AIIMS) in New Delhi for medical treatment. The court directed AIIMS to form seven member committee to submit the report in sealed cover in next 10 days on the medical condition of Bapu. Bapu’s Counsel argued in the Court that Bapu could not come by train as he would face hostile crowd at railway station. On which, the court directed that Bapu then should be brought by air to AIIMS for medical examination.

#Allahabad HC issues notice in PIL on flood relief works

The Allahabad High Court on August 29 issued notice asking for report on a PIL related to the flood relief works in Uttar Pradesh. The High Court also asked District Magistrate from seven districts including Varanasi, Allahabad, Mirzapur, Chanduali, Bhadohi, Ballia and Ghazipur to be present in the next hearing thereby adjourning the case to September 1.

#Allahabad HC directs CMO of Bareilly in abortion case  

The Allahabad High Court on August 29 while hearing a writ petition filed by a girl from Bareilly who was allegedly raped and got pregnant, and asking for permission for the abortion by the Court ordered the Chief Medical Officer of Bareilly to look in to this matter and take the decision accordingly. The girl didn’t want to have the child.

#CBI ordered to probe Sachan’s missing link

The Lucknow bench of Allahabad High Court on August 29 directed CBI to investigate the missing of Rahul Sachan, one of the witnesses in the Asaram Bapu Case. Sachan is a witness in two cases filed against Bapu in Jodhpur High Court. Sachan had gone missing under mysterious circumstances since November 26.

#Apex court issues notice on SLP pertaining law CET

The Supreme Court on August 29 issued notice while hearing a SLP against the Bombay High Court’s decision in the Maharashtra law common entrance test (CET) matter. The petitioner had challenged the Bombay HC order, which had rejected a plea challenging the CET.

#Supreme Court dismisses the case regarding Bamboo exemption  

The apex court dismissed the matter on August 29 pertaining to issuing a writ of Mandamus to Union of India to exempt Bamboo from the purview of Transit Pass regulations. The court did not find any merits in the case.

#Apex court defers hearing in Mallya’s contempt case

The Supreme Court on August 29 deferred the hearing of the case filed by a consortium of 17 banks including the State Bank of India seeking initiation of contempt of court proceedings against Vijay Mallya for non-disclosure of his assets to September 27 for final hearing. The apex court also asked the consortium to reply to Mallya’s plea seeking recall of an order asking him to disclose his assets within 10 days.

#PIL urging CBI probe in “Panama Papers” adjourned  

The apex court on August 29 granted four weeks time to file counter affidavit and two weeks time to file rejoinder affidavit in the PIL requesting CBI probe against the Indian off-shore bank account holders, as revealed in “Panama Papers”. The court adjourned the hearing of the case to October 3.

#Stray dogs culling: Apex court defers hearing

The Supreme Court on August 29 adjourned the hearing of the case regarding culling of stray dogs in the state of Kerala to September 2. Court asked the Kerala government to clarify whether culling of stray dogs will be conducted or not.

#Hearing of PIL regarding Ranbaxy’s directors adjourned  

The apex court on August 29 granted four weeks time to file counter in the PIL filed to direct respondent to initiate investigation and to prosecute all ex and present directors of the Ranbaxy under the Drug and Cosmetic Act of 1940. The court also said that this was the last chance given to file counter.

#CJM court to hear matter regarding actor Rakhi Sawant

A CJM court will hear a case on August 27 involving actor Rakhi Sawant, who was accused of wearing dress with the pictures of PM Modi printed on it.

#Allahabad HC to hear petition on flood relief works

A petition was filed on August 26 at Allahabad High Court related to the flood relief works in Uttar Pradesh. The Court will hear the matter on August 29. The petition alleges inadequate help to the victims during the floods. The petition also urges speeding up of the relief works.

#Supreme Court adjourns matter pertaining illegal mining in Odisha

The Supreme Court on August 26 allowed respondent in a case against illegal mining in Odisha to file within one week their reply. The PIL is regarding the ongoing loot and plunder of valuable natural resources in Odisha bypassing the environmental norms and the rights of the vulnerable tribal and rural communities.

#Apex court allows petition on triple talaq

The apex court on August 26 admitted a plea by Ishrat Jahan, a native of Howrah regarding triple talaq. The petitioner, Ishrat Jahan had filed a case against her husband who had given divorce to her on phone from Dubai. While admitting the plea, the court also tagged the petition along with a group of petitions to deliberate whether certain tradition of divorce and marriage under the Islamic personal laws encourages gender discrimination.

#Apex court adjourns matter on recent Kashmir unrest

The Supreme Court on August 26 told JKNPP leader Bhim Singh that if he wanted to go and meet the Hurriyat leaders to iron out a solution on the present unrest in Kashmir, he is free to do it in his personal capacity. The Court said that it will not give licence nor authorize Singh to visit Kashmir and said “it will also not stop Singh meeting anybody as India is a free country”. The Court adjourned the hearing of the matter till September 9.

#Bombay HC allows women to enter Haji Ali Dargah

The Bombay High Court on August 26 revoked the ban imposed on women from entering the sanctum sanctorum of Haji Ali Dargah. The Court said that the ban is contrary to Articles 14, 15, 19 and 25 of the Constitution of India. “The state government and the Haji Ali Dargah Trust will have to take proper steps to ensure safety and security of women entering the dargah,” the Court said. However, the Court put a stay on its order for six weeks on a plea by Haji Ali Dargah Trust, which wants to challenge it in the Supreme Court.

#Allahabad HC puts stay on the arrest of Akhlaq’s family   

The Allahabad High Court on August 26 stayed the arrest of family of Mohammed Akhlaq, who was lynched last year on the suspicion of cow slaughtering in the Bisada village, Noida. Akhlaq’s family had approached High Court after a session court directed the police to file a case against the family for storing and consuming beef. Akhlaq’s wife, mother, daughter and sons were made accused in FIR.

#Apex court agrees to take up the Tamil Nadu’s plea on water

The Supreme Court on August 26 agreed to hear Tamil Nadu govt’s plea seeking release of 50 thousand million cubic of water from Karnataka on September 2. The plea came after the Karnataka government had denied the TN government, water adjudging 2016 as the distress year.

#Rajya Sabha MP gets six weeks reprieve from arrest

The apex court on August 26 has granted six weeks protection from arrest to Rajya Sabha MP Sasikala Pushpa and her family in sexual harassment case. The court asked the Madras HC to decide on her petition for anticipatory bail. Pushpa’s maid had levelled charges against Pusha, her husband and son for sexual harassment.

#Local court to take up the case regarding IFFCO interest rate scam

The Karkardooma Court in New Delhi will hear a matter related to IFFCO interest rate scam on August 26. The Court will take the decision on ex-speaker from Haryana, Satvir Kadyan including other six accused. Earlier, the Court had convicted all of them in the scam.

#Supreme Court adjourns matter related to 72,825 trainee teachers

The Supreme Court on August 24 adjourned all special leave petition and writs regarding selection and appointment of 72,825 trainee teachers in Parishadiya primary schools in Uttar Pradesh which was listed as per the advertisement published in UP Basic Shiksha Parishad on September 30, 2011 to November 22, 2016. The Court directed the parties to file the counter affidavits.

#Human pyramids: Apex court rejects petition  

The apex court on August 24 rejected the application of an NGO seeking modification of height of 20 feet pertaining human pyramids during Dahi Handi celebrations in Mumbai. The Supreme Court refused to reverse its order dated August 17 in which it had ruled that height of the human pyramids should not exceed 20 feet and banned those below 18 from participating in the pyramids.

#Apex court adjourns hearing of defamation suit about RaGa

The apex court on August 24 deferred the hearing of the defamation suit related to Congress vice president Rahul Gandhi to September 1. Gandhi clarified his statement to the court saying that he never blamed RSS as an institution that killed Mahatma Gandhi. #Bombay HC defers case pertaining death of a scientist

The Bombay High Court on August 23 reserved the judgment on the PIL raising issue of death of scientist working with the atomic research center to September 30. The Court sought response from the respondent Union of India on the issue. The petition had said that through RTI it was revealed that a large number of scientists died while working in the center and a few of them committed suicide also. And the mysterious death of the scientist had not been investigated. According to the petition, safety measures for health have been neglected within the atomic research center resulting into the death of scientist.

The petitioner’s lawyer argued that the Union of India which provided the data of deaths of the scientists before the court does not match the data which was received by the petitioner through RTI as the Union government data showed fewer deaths.

#BCI offers relief to DU

In a big relief to law students of Delhi University, the Bar Council of India (BCI) has put on hold its decision to bring down the number of seats in law courses for this academic year (2016-17).

According to BCI, Delhi University had far exceeded the number of seats mandated by the legal education regulator. The Dean of Law Faculty, Delhi University, has assured through a written undertaking that BCI’s stipulations will be adhered to strictly from the next academic year.

BCI also wanted Delhi University to do away with evening law courses at its colleges. This diktat will also be implemented from the next academic year. As of now, second and third year students pursuing evening law classes will continue with their curriculum.

#Madras HC refuses to stay suspension of DMK MLAs

The Madras High Court on August 22 refused to stay the suspension of DMK MLAs by Tamil Nadu Speaker. #Justice Chellur: new Chief Justice of Bombay HC

Justice Manjula Chellur took oath as the new Chief Justice of the Bombay High Court on August 22. She replaced Justice DH Waghela who retired after a brief stint. Chellur became the second woman Chief Justice of Bombay HC. Chellur has many firsts to her name. In September 2011, she took charge as the first woman Chief Justice of the Karnataka High Court. She again became the first woman Chief Justice of the Calcutta High Court in 2014 and had been serving until now.

The Bombay High Court on August 22 adjourned the hearing for 12 weeks of the PIL which seeks directions to remove the illegal Shiv Vadapav stalls by political party, Shiv Sena. The Court directed the Brihanmumbai Municipal Corporation (BMC) to furnish the data as how many stalls of Shiv Vadapav were functioning in Mumbai without licence. The Court was informed that there were number of stalls in the city not having valid licence and even BMC had accepted this in its reply.

A Delhi court on August 22 sentenced death penalty to two of the convicts in the IT executive Jigisha Ghosh in 2009 murder case. The court charged Ravi Kapoor and Amit Shukla for kidnapping and killing Ghosh thereby handing out capital punishment to them while third convict Baljeet Malik was sentenced life imprisonment. The court adjudicated the crime as “rarest of the rare”.

The Bombay High Court on August 18 has deferred the hearing of petition raising issue of illegal installation of cellphone towers in Mumbai city especially near Juhu area. The petitioner Juhi Chawla and others have filed the case. The petitioner wants that cellphone towers should not be installed near residential areas, hospitals or parks.

#Bombay HC tells CBI to file a report

The top court of Maharashtra on August 18 directed the CBI to file a report by August 25 answering prayers raised in the petition regarding scam tainted Adarsh housing society. The court also examined a bunch of intervention applications filed by various accused named in chargesheet filed by CBI. The court rejected some of the application also. The petitioner had filed a criminal application seeking direction to issue show cause notice to CBI as why it had not investigated that how the land where the scam tainted Adarsh Housing Society was constructed; and given approval by the government. Earlier, the Court had directed to demolish the Society and recently the Indian Army took possession of the building.

#Bombay HC refers Dahi Handi case to another bench

The Bombay High Court’s bench of Justices Abhay Oka and Amjad Sayed on August 18 has refused to entertain the petition regarding issue of human pyramid during Dahi Handi festival. The Court said that as per changed assignment the bench of Justices Oka and Sayed takes PIL filed till 2011 thereby directing the petitioner to file the case before the appropriate Bench.

#Navajo Nation files case against EPA

Navajo Nation has filed a case against the Environmental Protection Agency (EPA). The Navajo Nation has alleged that EPA was responsible in the spilling of three million gallons of toxic waste into the Animas River in Colorado and New Mexico in a lawsuit. The incident shot into the limelight as “Gold King Mine Spill”. The petition says that the “Nation and the Navajo people have yet to have their waterways cleaned, their losses compensated, their health protected or their way of life restored”.

#Spanish poet Lorca’s murder case to be re-investigated

Legendary Spanish poet Federico Garcia Lorca’s murder case which dates back to 1936 is set to re-investigated. An Argentine federal judge Maria Servini will take up the case. Servini is already investigating Franco-era crimes ranging from extra-judicial killings to torture. Lorca was killed in August 1936 allegedly by firing squad loyal to fascist General Francisco Franco.

#Kanhaiya Kumar’s plea for permanent bail dismissed

The Delhi High Court on August 17 dismissed the plea of JNUSU President Kanhaiya Kumar seeking permanent bail on sedition charges. The Court told Kumar’s Counsel to approach the sessions court. Kumar is out on the interim bail and his bail is slated to expire on September 1.

#Bombay HC specifies DOB certificate’s validity

The Bombay High Court on August 17 held that date of birth in the certificate issued by the school to be given preference to the birth certificate given by the corporation for the purpose of ascertaining the age of victim. The court granted conditional bail to the accused till the final disposal of his appeal challenging his conviction under Protection of Children from Sexual Offences Act by lower court.

#Setalvad granted five weeks time to go abroad

The Supreme Court on August 17 granted five weeks time to Teesta Setalvad to attend her daughter’s marriage. The Court also said that Setalvad would have to surrender her passport after five weeks. She can file petition under the section 226 and if High Court denies it, then she can approach the apex court, the Court said.

#Bombay HC quashes externment order

The Bombay High Court on August 17 quashed an order of Externment holding it violation of constitutional provision. The Court was hearing a petition challenging the order of Externment issued against the petitioner under section 56(1) (b) of the Maharashtra Police Act 1951. The petitioner submitted before the court that order of Externment is contrary to law and there was no material with the police to initiate the Externment against him. The Maharashtra government argued that there is compliance of procedural safeguards and taking into consideration the activities of petitioner, the Externment was initiated.

#Supreme Court clarifies on the height of pyramids  

The Supreme Court on August 17 said that height of the human pyramid should only be 20 feet and age of the participants should not be below 18 years for the Dahi-Handi celebrations in Maharashtra. Earlier, Bombay High Court on Aug 11, 2014 had directed that the height of human pyramid should not exceed 20 feet and children below 18 should not be allowed to participate in the Dahi-Handi function. Last month, the High Court had directed the Maharashtra government to approach Supreme Court to decide the same.

The Supreme Court on August 16 granted two weeks time to the petitioner to go through the compliance report filed by the Union of India. Earlier, the apex court had directed the states and Union of India to file compliance report. The Public Interest Litigation relates to a fire which swept the Lord Krishna Middle School in District Kumbakonam in Madras. The fire started in the school’s kitchen while cooks were preparing mid-day meal. In order to protect the rights of life and education guaranteed to all school going children under Articles 21 and 21-A, the petitioner had prayed to bring about safer school conditions.

The Bombay High Court on August 16 was informed by the plaintiff as well as the respondents that they are willing to settle the matter and will file consent terms accordingly. The suit was filed before the release of the film seeking relief against the respondents who allegedly made available the link of the film on internet even before its release.

The PIL is related to a school fire in Tamil Nadu. It has sought proper safety for school-going children. An internet magnate, Gurbaksh Chahal was slapped a one year jail term for violating his probation in a domestic violence case. Chahal was implicated for allegedly kicking her girlfriend. Chahal is a serial offender when it comes to treating women. He has been indicted several times for outraging the modesty of women. He was also earlier charged for kicking his former girlfriend. Chahal shot into the limelight for selling his internet company for $300 million at the age of 25.

#Dilma Rousseff issued date for impeachment trial 

Brazilian President Dilma Rousseff will undergo a final impeachment trial on August 25 by the country’s Supreme Court. The Senate voted in favour of the trial after a recommendation to do so by its impeachment committee. According to an impeachment committee’s report, Rousseff violated the Constitution by intentionally holding up payments to public banks and passing additional credits without the nod of Congress, allegedly in order to conceal a growing shortfall in public finances.

#Add defence ministry as party, tells Bombay HC

The Bombay High Court on August 11 directed the petitioner to add Ministry of Defence as a party in the petition so that the Indian Army could be instructed to construct a temporary bridge between Sandhurst Road, Mumbai and Dockyard Road railway station, Mumbai. The court was informed that Brihanmumbai Municipal Corporation has communicated with army authorities however the fruitful result has not come yet. It was suggested during hearing that only Army can construct a temporary bridge in shortest time period. The British era bridge was demolished due to its poor condition. In the absence of bridge, people were compelled to cross railway track. Two students had died also while crossing the track.

#AIADMK MP gets reprieve to seek judicial remedy

The Delhi High Court gave major relief to expelled AIADMK MP Sasikala Pushpa and two of her family members on August 11. The Court granted interim protection from arrest to Pushpa and family members till August 22 after charges of sexual harassment against her and family members were slapped on her by their domestic help. The Court granted her reprieve to seek judicial remedy and directed that no coercive action should be taken against her till August 22.

The Bombay High Court on August 9 directed the Maharashtra government to produce all the details about construction of new high court building by Jan 10, 2017. The Court said that Mumbai is financial capital of country and the new high court building should be constructed keeping in mind the reputation of the city. The paramount issue is the facilities of the litigants, the court said. The court was informed that the government will appoint an international agency to do all the necessary things regarding new high court building.

#SLP on Dahi-Handi celebrations deferred

The Bombay High Court on August 9 adjourned the hearing of a special leave petition to August 10 regarding the height of human pyramids for the Dahi-Handi celebrations in Maharashtra. Bombay High Court on Aug 11, 2014 had directed that the height of human pyramid should not exceed 20 feet and the children below 18 should not be allowed to participate in the Dahi-Handi celebrations. In July 2016, the High Court had directed the Maharashtra government to approach Supreme Court to decide the issue.

#Bombay HC defers PIL on Mahad Bridge collapse

#Apex court refuses to intervene in NEET paper leak case

The Supreme Court on August 9 declined to entertain a plea in quest of court-monitored investigation into the alleged leakage of the NEET question papers in Uttarakhand. The Court asked the petitioner to approach the High Court of Uttarakhand as the alleged leak happened in the state. The Court passed the order after listening to respondent’s plea, CBSE which said that leaked paper didn’t match with the real paper.

National Green Tribunal on August 9 submitted the plea of Tata Motors regarding the registration of diesel vehicles above 2000cc and allowed its hearing on the next date. Tata Motors told the Tribunal that Supreme Court’s had put a ban on the registration of private diesel vehicles above 2000cc. But Delhi government has banned registration of commercial diesel vehicles as well.

#Delhi HC issues notice to Centre on Airtel’s plea

Delhi High Court on August 8 sought Centre’s response on Bharti Airtel’s plea seeking refund of over Rs 2,500 crore, which includes disputed licence fees of Rs 399.92 crore paid by it for its Punjab circle for 1996-98 and interest on the amount. The Court issued notice to the Department of Telecommunications (DoT) and sought its reply by September 29 on Airtel’s plea.

The court directed the Ministry of External Affairs to send the warrant to Mallya who is reportedly now in London. Preceding this order, another trial court in Delhi had summoned Mallya for a cheque bounce case on a compliant of DIAL, which operates Indira Gandhi International Airport.

The Court was hearing the case in which the petitioner had sought Governor’s rule in Jammu and Kashmir due to curfew in the aftermath of the terrorist Burhan Wani’s execution. The Court granted reply to the petitioner after examining Solicitor General’s status report of ground realities in Kashmir. The report said that the government has made sufficient arrangements for medical facilities. Sufficient blood is available with the blood bank. Free food is given to all the patients. Surgeries and OPDs are working. Adequate foodgrains are available. Taking cue of the report, the Court asked the petitioner to file reply on the report and listed the matter on August 22.

#CBI files supplementary chargesheet against Rajan

The CBI today filed a supplementary chargesheet against gangster Chota Rajan in senior journalist J Dey’s murder case in Maharashtra Control of Organised Crime (Act) court in Mumbai on Monday 5. According to the chargesheet, Rajan ordered the killing of Dey for writing a book on the underworld that showed him in poor light against his enemy Dawood Ibrahim, India’s most wanted fugitive.

The apex court on August 5 transferred all four petitions to Delhi High Court while hearing a transfer petition. The court on the last hearing had directed ASG, Maninder Singh to find out why Union of India are not passing rules recommended by Animal Welfare Board of India on the poor condition of the chickens in the poultry farms. Singh submitted today that Union of India is in the process of passing the rules.

The Supreme Court on August 5 directed the petitioner’s counsel to file application for direction within 2 weeks in the PIL concerning implementation of Persons with Disabilities Act. The apex court is monitoring the implementation of the provisions of the act by each state and also by Union of India. Persons with Disabilities Act protect the rights of differently-abled people ensuring them employment in various government sectors and departments.

#NGT threatens coercive orders regarding discharge of sewage

National Green Tribunal on August 5 slammed the concerned departments on the matter regarding discharge of sewage in Yamuna. The Tribunal expressed its disappointment on why its guidelines were not implemented even after passing the judgment in January 2015. The Tribunal in the judgment had directed the parties to install sewage treatment plants to treat sewage thereby ensuring less pollution for the river. In today’s proceedings it slammed the departments on not installing the plants and therefore directed the departments to install the plants. It issued to notice that in the event of disobedience of judgment/obstructive steps for preventing the execution, the tribunal will pass coercive orders including civil imprisonment of official’s persons responsible.

Following that amendment, the court asked the petitioner to mention in the amended petition that the then child is now a man.

She had alleged that she was receiving death threats after being slapped by a party leader.

The Court said that if government fails in doing so, then a contempt notice will be issued. The Court was today informed by the petitioner that the commission is functioning without any facilities. There is no place of keeping the record and register. On the last hearing also, the Court had pulled up the government for inaction.

#Seven years imprisonment for Peepli Live co-director

A lower court on August 4 sentenced seven years imprisonment to Peepli Live co-director Mahmood Farooqui for sexual assault of a US researcher in New Delhi last year. The court also imposed a fine of Rs 50,000 on Farooqui. If Farooqui does not pay the fine, then he will have to face three more months of imprisonment. Farooqui was pronounced guilty on July 30. The prosecution sought life imprisonment for Farooqui alleging that the crime has brought disgrace to the nation.

#Minors can be jailed in Israel

Israel has promulgated a law which mandates the imprisonment of minors under the age of 14 charged with crimes of terrorism. The law also recognises serious crimes such as acts of terror, attempted homicide and murder for sentencing jail term to minors as young as 12. The country while promulgating the law took a strong note of the recent spate of crimes by minors observing that a more aggressive approach would be needed to put a check on that.

#Gujarat HC dismisses ordinance on EWS quota

The Gujarat High Court on August 4 struck down Gujarat government ordinance on 10 per cent quota for economically weaker sections (EWS) in educational institutions and government jobs while hearing a set of petitions. Upholding the quota as illegal and unconstitutional, the court said that the quota violates the guidelines of the Supreme Court. The state government after the verdict sought two weeks time to appeal in the apex court against the judgement. Granting the permit, the Court stayed its order for two weeks.

#Bombay HC takes strong note of absconding prisoners

The Bombay High Court on August 4 directed the Maharashtra government to produce a chart of absconding prisoners till September 2016. The court also directed the government to constitute a committee comprising of senior police officers and senior members of bar to make suggestions on the issue. The court also directed the government to consider the suggestions made by amicus curaie Shekhar Jagtap. The government produced a chart stating that till March 2016, total 667 prisoners have absconded while they were out on parole or furlough. The advocate general told the court that to stop this, biometric record of the prisoners will be taken. However all these measures would be related to only convicted prisoners. The court also asked to take measures regarding undertrial prisoners who are on bail but abscond to escape punishment.

#SC refuses to revisit anti-defection law

The Supreme Court did not delve into its 1996 verdict on anti-defection law as pleaded by politicians Amar Singh, Jaya Prada and P Mohapatra. All of them were expelled from their respective political parties. The court felt that the issue had lost relevance considering that they had already completed their tenure as MPs.

This means that the 1996 judgment wherein expelled MPs in parliament were still bound by the party whip shall remain unchanged.

While Jaya Prada and Amar Singh were expelled from SP, Mohapatra was thrown out of BJD. All of them wanted to know whether they still had to abide by the party whip after being thrown out with reference to the 1996 verdict.

#Delhi HC angry over manual scavenging

Aghast at the fact that more than 200 manual scavengers still existed in Delhi, the Delhi High Court on August 3 took a serious note of the incorrect information presented by civic agencies. They had claimed that there were no manual scavengers in the capital. However, a report from the Delhi State Legal Services Authority filed before the court stated that 233 people were on the rolls of civic agencies as manual scavengers.

The court was also not happy with the civic agencies for allowing such “disgraceful” practice to exist in today’s age.

Philippines have passed a law which bans employers from urging age limits in their hiring process. The law aims to encourage equality in the workplace by ordering companies to employ workforce on their merits, and not on their age. The law prohibits companies from bringing out job advertisements that suggest preference for a specific age group. The law also bars job applicants to declare their age during the hiring process.

A new law introduced by Texas State that lets people to carry concealed handguns into college campuses is facing an unusual protest. The college students in Texas are planning to bring dildos (a vibrating device that substitutes for an erect penis to provide vaginal stimulation) in the classrooms as a mark of protest against the law. The demonstration called “Campus Dildo Carry” will be held on August 24. According to the reports, the students will carry dildos on the outside of their backpacks and will stroll into the classrooms pretending that there is nothing unusual.

The court was concerned as August 15 (the kite flying festival) was not far away. The Delhi government informed the court that the notification was pending LG’s approval.

#Haryana govt issued notice on JBT teachers’ plea

The Haryana government on August 2 was issued a notice by the Punjab and Haryana High Court. The court fixed August 29 as the date for the government and appellants to file their replies on plea. The Court was hearing a plea filed by around 9,000 junior basic trained (JBT) teachers seeking vacation of a stay on their appointment. The High Court had put a break on the appointment of JBT teachers after hearing an appeal which claimed misdeeds in their selection process. The teachers were recruited during the Bhupinder Singh Hooda government in Haryana.

The Supreme Court asked the counsel for Mercedes Benz to give it in writing that it was ready to pay  one percent of the ex-showroom price of diesel vehicles, with engine capacity 2,000 or more, as “green cess”. In a major relief for the BJP president Amit Shah, the Supreme Court put to rest the Sohrabuddin fake encounter case. Shah was earlier declared not guilty by a CBI court after being chargesheeted. The apex court struck down the appeal of a social activist, Harsh Mander, who pleaded that Shah was guilty. Earlier, the Bombay High Court had struck down Mander’s appeal against Shah’s release.

The Supreme Court gave the verdict on a petition by an NGO, Lok Prahari questioning the legality of 1997 Ex-Chief Minister Allotment of Residence Rule. By this rule, UP government can allot bungalows to the Ex-CMs. The NGO alleged that the UP government made this rule in contravention of the order of Allahabad High Court.

The Supreme Court today cleared the name of Andhra Pradesh in Union of India’s supervising committee to oversee the functioning of Babhali baragge. The issue was that why the name of Andhra Pradesh’ name should be included in the committee as the state has been bifurcated. Telangana submitted that Telangana is the only state which should be part of the committee and Andhra Pradesh has no right to be part of the committee. Andhra Pradesh said they also have a right to Godawari river water and therefore they cannot be excluded. Maharashtra had also objected to the inclusion of Andhra Pradesh in the committee.

#Enact law on cow slaughter

The Himachal Pradesh High Court has asked the central government to come up with a law that bans cow slaughter in India. The court also wanted the centre to stop import and export of cow or calf that are slaughtered, as well as ban the sale of beef and beef products, all within six months. It did not agree with the centre’s contention that it was the state’s prerogative to decide on the issue.

This is the second time that the High Court has issued the verdict. It did the same last October.

#Actor Rajpal Yadav’s plea dismissed

The apex court ruled that Bollywood actor Rajpal Yadav will have to serve the remaining six days of his jail term awarded by the Delhi High Court unless he pays back the money he had taken from a Delhi-based businessman, immediately. The High Court in 2013 had sentenced the comedian to 10 days judicial custody for misleading the court. Yadav has already spent four days in jail. His plea against the High Court order to serve the remaining term was not accepted by the apex court.

#Siri Fort sports complex will stay: NGT

The National Green Tribunal (NGT) has ruled out the demolition of the Siri Fort Sports Complex in New Delhi. The order encompasses the squash and badminton courts as well. #Rahul gets a reprieve in RSS case

Congress vice-president Rahul Gandhi may have got a reprieve in the case where he had been asked to either say sorry or face trial by the Supreme Court for saying that RSS has bumped off Mahatma Gandhi. While delving into the case, the Supreme Court found that the Maharashtra court—where a criminal defamation case had been filed under Sections 499 and 500 of IPC by a RSS worker against Rahul Gandhi—may have erred by involving the police. This could result in the case being sent to that court or being heard all over again. According to the apex court, the police have nothing to do in criminal defamation cases.

A special court to hear National Spot Exchange Ltd-related cases on a priority basis has been set-up by the government, an official statement said. #Plea against matrimonial websites

The Bombay High Court recently heard a petition objecting to matrimonial websites posting advertisements on dowry management and demanded that these were violating the Dowry Prohibition Act 1961. The petitioner even wanted that such websites be blocked. The counsel for state government contended that the centre was in a better position to do the job under the Information Technology Act. The petitioner however, argued that the issue had more to do with the Dowry Prohibition Act. The Court wanted Additional Solicitor General remain present for the next hearing.

#Virginia Supreme Court rejects governor’s order  

The Virginia Supreme Court recently overruled Virginia Governor Terry McAuliffe’s decision to give back voting rights to more than 200,000 outlaws who had completed their sentences. The court lambasted McAuliffe for issuing a sweeping order in April in this regard.

#SC quashes marriage alliance case 

The Supreme Court recently quashed a case after it found that a boy’s family had refunded all expenses incurred by the girl’s family at the time of engagement. The boy’s family had broken off the alliance after the engagement. The girl’s family had sought legal redressal thereafter from a Thane court. On trial court’s order, the boy’s family had paid Rs 1.50 lakh as reimbursement. But still the case, filed under Section 420, was not withdrawn. Even the Bombay High Court had refused to grant them relief. The apex court with prosecution’s approval felt that no case existed.

#Delhi HC seeks info on missing kids

The Delhi High Court wanted the centre to submit the latest version of the model standard operating procedure (SOP) for keeping a track of missing children. It was responding to a plea seeking information on the efforts made by the police and the government on the matter.

The woman and child development ministry had filed two different versions of SOP and this had raised the hackles of the High Court.

#Supreme Court issues notice to EC

The Election Commission was served a notice by the Supreme Court on allegations that it had not implemented an apex court’s 2013 order on convicted lawmakers. The petitioner, an NGO, claimed that no systemic changes had been initiated to ensure that elected representatives were automatically disqualified from state legislatures or Parliament on being held guilty by law. The plea contended that they continued to hold office despite being convicted of heinous crimes.

The porters lug supplies, ration and ammunition for the Army in hilly terrain, Concerned that the system was taking them for a ride, the court took a serious note of complaints that they were not being paid minimum wages and there was no job security for them. It wanted a detailed report on the prevailing situation.

#SC demands medical test for abortion  

The Supreme Court ruled on Friday that a committee of doctors formed will examine the woman who had requested the court to allow her to abort her 24-week old foetus. The court asked the woman to be present at a government hospital in Mumbai by 10 am on Saturday for medical examination. It wanted the report of the examination by Monday when the matter will again come up.

The woman had raised objection to Section 3 (2) (b) of the MTP Act 1971 that does not allow termination of pregnancy if the foetus is more than 20 weeks old.

#Centre to take over Adarsh Society building

The Supreme Court issued orders to the centre for taking possession and securing the Adarsh Housing Society building in Mumbai. It also served notice to all concerned with the building after hearing petitions against the verdict of the Bombay High Court. The high court had in April asked the civic agencies in Mumbai to raze the 31-storey building.

The apex court also asked the Registrar General of the Bombay High Court to make sure that the building is handed over to the centre by August 5.

#Hearing on abortion petition

A metropolitan court in Mumbai today sent Pradhyuman Yadav, the suspended sub-inspector of Gurgaon police, to judicial custody for two weeks. Yadav is a key accused in the Sandeep Gadoli case. Gadoli was allegedly shot dead in a fake encounter by Yadav’s team in Mumbai.

#Bombay High Court adjourns BMC road scam

The Bombay High Court has adjourned the hearing to July 21 in the BMC road scam. The court is likely to pronounce sentence for the three accused, who are in custody on that day. So far, 22 people have been granted bail in this case.

#SC slams Rahul Gandhi for inappropriate remark

The apex court today condemned Congress vice-president Rahul Gandhi for his statement that RSS was behind the assassination of Mahatma Gandhi. The court said that he will have to face trial for criminal defamation to prove his innocence. It has deferred the hearing and directed Gandhi to submit his arguments by July 27.

#Apex court defers hearing on Maggi

The Supreme Court today adjourned the hearing of an appeal by Nestle against the order of the National Consumer Dispute Redressal Commission. The order had asked Nestle for further tests on Maggi noodles. The court had to defer the hearing as the counsel for Nestle was not present.

#Bombay High Court seeks explanation from BMC

The Bombay High Court today issued a notice to BMC. The notice is related to 12 cardiac ambulances purchased by the civic agency. Each of the ambulance had cost BMC Rs 60 lakh. The petitioner alleged that even the best high-tech ambulance was available for around Rs 20 lakh only.

#Supreme Court to decide upon constitutional validity 

The Supreme Court will hear a batch of appeals by Jindal Stainless Ltd and ANR today regarding the constitutional validity of the Haryana Local Area Development Tax Act, 2000. It has been challenged on two grounds: (1) that, the Act is violative of Article 301 and is not saved by Article 304; and (2) that, the Act in fact seeks to levy sales tax on inter-state sales, which is outside the competence of the State Legislature.

#Bombay High Court to hear PIL on rent issue

The Bombay High Court will hear a PIL which involves schools premises that were given on lease to NGOs. However, there were no lease agreements signed between the parties. Due to no lease agreements, parties involved are facing problems. Two previous orders have been given by the courts. However, the authorities still have not maintained records of these leases.

#SC defers verdict on judges’ allotment

The Supreme Court today heard a PIL for the allotment of judges in Telangana and Andhra Pradesh. The court issued notice to Telangana, Andhra Pradesh and the centre. The matter will now come up before the court in four weeks’ time. The Telangana Judges Association had filed the PIL seeking that an advisory committee responsible for allocation of judges between Telangana and Andhra Pradesh be set up by the government. The centre submitted that it had already constituted the committee which had made recommendations.

#PMLA Court extends Bhujbals’ judicial custody

A Prevention of Money Laundering Act court today extended the judicial custody of NCP leader Chaggan Bhujbal and his nephew Sameer Bhujbal till July 29 in the Maharashtra Sadan scam. The special Anti-Corruption Bureau has already granted bail to the Bhujbals. Earlier on March 14, the Enforcement Directorate had arrested them on charges of money laundering.

#No verdict yet in Sheena Bora case

The special CBI court today extended the judicial custody of all accused in the Sheena Bora murder case till August 1. The court had last week deferred the hearing on Peter Mukerjea’s (one of the accused) plea seeking statement of one of the witnesses. On July 4, the court had extended the judicial custody of Indrani Mukerjea, Sanjiv Khanna and Peter Mukerjea till July 18.

#Trouble for 10-year-old diesel vehicles

The National Green Tribunal today directed that diesel vehicles above 10 years old be de-registered with immediate effect in Delhi. The tribunal asked the Regional Transport Office, Delhi, to file a list of all 10-year-old vehicles and hand over the same to the traffic police of Delhi.

#Apex court accepts Lodha panel suggestions on BCCI

The Supreme Court today gave the nod for major recommendations of the Lodha panel on organizational changes in the BCCI. It also directed the panel to ensure implementation of the suggestions within the next six months. The court asked the panel to get back in case of any difficulty.

#NGT restricts use of horns in Delhi

The National Green Tribunal today directed that no vehicles will use pressure horns or horns flouting noise pollution norms. It also asked the Ministry of Environment and Forest to provide details in an affidavit on the method, rules and norms for using horns in Delhi, including in two-wheelers. It also asked the ministry to identify silent zones and the norms for that zone.

#Jignesh Shah sent to judicial custody under PMLA

Jignesh Shah, the founder of National Spot Exchange Limited (NSEL), was today sent to judicial custody in the NSEL payments default case by a special PMLA court. The court also fixed August 3 and 4 for framing of charges against the 38 other accused. It directed them to be present on those dates. The Enforcement Directorate had arrested Shah on July 12, 2016 under PMLA. In March 2015, the agency had filed a chargesheet against NSEL and 67 others under PMLA.

#PIL on mental patients

A PIL filed by Gaurav Kumar Bansal seeking intervention of the Supreme Court in a matter related to patients admitted in a mental hospital in UP was heard today. The PIL had raised objection to patients staying in the hospital even after they had fully recovered. The court issued notices to all the concerned parties and will look into the matter.

#Kalkaji Mandir issue deferred

The apex court took up a PIL on ensuring cleanliness of the Kalkaji Mandir and its surroundings in south Delhi. The court-appointed committee suggested some steps for the same as per the court’s directions like involving the DDA to maintain the park nearby, keeping clean the toilets in the Mandir’s vicinity, setting up barricades, deploying volunteers for the job, etc. The matter will again come up on October 6, 2016 and the court is likely to hear all the parties.

#Bombay HC adjourns recruitment issue

The Bombay High Court today adjourned the hearing of the case on the recruitment of secretary, public works department in Maharashtra for two weeks. The respondents had sought adjournment as the concerned public prosecutor was not present. The petitioner had sought interim relief in the matter as the stated rules for recruitment to the post of secretary, public works department were struck down.

#Madras HC bans ISPs-websites from releasing Kabali 

The Madras High Court today banned 225 websites and 169 internet service providers (ISPs) from releasing Kabali which stars Rajnikanth. The court ordered the ban after hearing the petition from  film’s producer, Kalaipuli S Thanu. Thanu in the petition had sought protection from piracy and had requested the Court to direct ISPs to block websites that might have released Kabali.

The House of Representatives have approved the law and sent to President Barack Obama who is expected to sign it into law. The law requires most food packages to carry a symbol, a text label or a QR code decipherable by smartphone that reveals whether the food contains genetically modified ingredients.

Microsoft secured a major moral victory today when a US appeals court denied the US Department of Justice to access the firm’s servers located in other countries. Hailing the judgement, Microsoft said, “This decision provides a major victory for the protection of people’s privacy rights under their own laws rather than the reach of foreign governments.” The US appeals court reversed a 2014 decision directing Microsoft to deliver messages of an alleged drug peddler.
