bail under Section 167

A single-judge bench of Allahabad High Court while hearing an Application under section 482 filed by Sallahuddin while dismissing an application observed that after filing of charge sheet and cognizance by magistrate application for default bail under Section 167(2)(a) CrPC is not maintainable.

The Delhi High Court has observed in a bail application that “it was the court’s obligation to inform the petitioner of his right to bail under Section 167(2) of the Cr.PC.”
