BSP MLA Mukhtar Ansari’s wife has moved the Supreme Court seeking security and protection for her husband while he’s shifted to Banda jail, while he’s lodged and when he’s produced before the Judge.

The petitioner, Afshan Ansari, cited imminent threat to his life (on account of having successfully contested elections against BJP and being witness to cases against members of BJP in UP). She prayed that authorities concerned be directed to ensure he is given a fair trial and not encountered.

It was alleged in the petition that mafia don Brijesh Singh has become highly influential in the state of Uttar Pradesh despite being incarcerated in jail and continues to be a constant threat to the life of petitioner’s husband. The political rivalry between Brijesh Singh and the petitioner’s husband is well known in the state of Uttar Pradesh and associates of Brijesh Singh have been blatantly making public statements to take the petitioner’s husband’s life.

The petitioner’s husband is a co-accused in the case of murder of BJP MLA Krishna Nand Rai, Prem Prakash Singh @ Munna Bajrangi (who was also acquitted) was planned to be shifted to District Jail Baghpat. An application on behalf of Munna Bajrangi was filed to produce him in the Court from District Jail with police protection as he was apprehending state sponsored encounter. However, nothing was done and on 9.7.2018 Munna Bajrangi, under the pretext of being shifted from one jail to another under “TALARI” warrant, was found murdered within the jail. The petitioner feared that in absence of direction by this Hon’ble court, her husband would meet with the same inescapable fate, the petition stated.

It is submitted in the petition that the conduct of the state of UP in dealing with the one accused Vikas Dubey was highly criticized where while transferring him to the prison, he was encountered on the way. Similar reports are being given in the press in relation to the petitioner’s husband .

Another example of accused named Girdhari was given in the Petition, who was alleged to be the shooter in the murder case of one Ajit Singh, was shot dead by Uttar Pradesh Police in an encounter on February 15, 2021 while taking him in police remand, on which the Supreme Court has taken cognizance. In such circumstances, it cannot be expected from the State of Uttar Pradesh to secure the fundamental rights as provided to the Petitioners husband in the Constitution, but for necessary directions passed by the Apex Court.

It was further alleged that the constant harassment being caused to the petitioner and her family under influence of political pressure is proved from the fact that multiple false, frivolous and bogus FIRs have been registered under sections of the IPC and Arms Act against the petitioners family, including her sons Abbas Ansari and Umar Ansari, national level gold medalist and state level medalist sportsmen respectively, with an intention to spoil his career. With the political rivalry, the officers demolished the house located in Dalibagh of Lucknow constructed by petitioner’s mother-in-law late Rabiya Begum, without any prior notice and took a proceeding against a demised person who is against the principle of the natural justice.

“The petitioner has been informed from sources that some shooter in the guise of a lawyer along with the lawyer will carry out the murder / ruthless killing of her husband during the course of his appearance in trial before Special Judge (MP / MLA), U.P. And these plans are being made at the behest of some higher rank officers at the behest of the Government of Uttar Pradesh. With all the consequences, the criminal Brajesh Singh MLA who is currently in the Banaras jail and is the bitter enemy of the Petitioners husband, BJP MLA Sushil Singh, criminal Tribhuan Singh, along with Alka Rai, MLA and the Governor of the Jammu & Kashmir vis . Shri Manoj Sinha, has made a common conspiracy with the high officers for killing of the Petitioners husband. Even during the budget session, the Hon’ble Chief Minister of Uttar Pradesh had represented my husband as ‘guilty’ and the ministers are openly saying that “how long the mother of the goat will celebrate”. Thus, there is all possible ground and apprehension, backed by facts, which reflect that Petitioners husband will be killed in absence of adequate protection,” the Petition reads.

ILNS: The Supreme Court on Friday allowed a transfer petition filed by the state of Uttar Pradesh seeking the transfer of Uttar Pradesh MLA Mukhtar Ansari from the Ropar jail in Punjab to the Banda jail in Uttar Pradesh.

A Bench of Justice Ashok Bhushan and Justice R. Subhash Reddy directed that Ansari should be handed to Uttar Pradesh within two weeks and he shall be lodged in Banda jail.

The Court was seized of two transfer petitions, one filed by UP government seeking transfer of Ansari from Punjab to UP and another by Ansari, who has sought a transfer of cases against him to Delhi. The transfer plea by Ansari was dismissed.

The MLA from Mau Sadar seat was lodged in a jail in UP as an undertrial, when the Punjab Police obtained production warrant against him on a complaint of extortion and criminal intimidation and brought him to Punjab.

He was lodged in Ropar jail in Punjab, when the UP government moved Supreme Court for his transfer back to UP.

Solicitor General Tushar Mehta, representing the Uttar Pradesh government, had submitted during the hearing on March 3 that Ansari was “operating his business from Ropar Jail in Punjab”.

Mehta contended that the FIR, which led to the arrest of Ansari by Punjab Police, did not name the MLA specifically and that Ansari was taken to Punjab after he was handed over by Banda Jail Superintendent, without a direction from the Magistrate.

The concerned jail officer has already been placed under suspension. Further, Uttar Pradesh also raised questions on the veracity of health issues cited by Ansari, added the SG.
