The PIL has been filed in Gauhati High Court by a social worker, Tarak Takhe. It has been pleaded that the land acquired is in connection with a power project and illegality has been done to benefit private respondents. 

The Madhya Pradesh High Court bench presented the arguments of both party counsels and observed that in the exercise of its powers, the court can entertain a writ petition under Article 226 of the Constitution of India.
