Allahabad High Court faces impostor allegation in bungalows case

The affidavit said the person who appeared in Court is Prem Chandra Sahu, who was falsely introduced as Nehru, on the strength of two Aadhaar cards held by Sahu, one as himself and the other as Nehru.

The story of Ajay Yashwant Nehru, the owner of Bungalow Nos. 52/38 and 52 E, located on Amarnath Jha Marg, Prayagraj in Uttar Pradesh, has got complicated.

A few days ago, when Nehru appeared in the Allahabad High Court on a wheel chair, it seemed the story of his being alive has been put to an end. But the affidavit of the other party has questioned if it indeed was Ajay Yashwant Nehru in Court. 

The affidavit said the person who appeared in Court is Prem Chandra Sahu, who was falsely introduced as Nehru, on the strength of two Aadhaar cards held by Sahu, one as himself and the other as Nehru. 

The Allahabad High Court on Thursday directed both Ajay Yashwant Nehru and Prem Chandra Sahu to appear in Court together. The Court said they have not confirmed the person appearing in Court to be Nehru. Rather, it is directed to give security.

A Single-Judge Bench of Justice Pankaj Bhatia passed this order while hearing an application under Section 482 filed by Nehru.

The High Court has passed a detailed order on March 9, 2021 on which date a man claiming to be Ajay Yashwant Nehru appeared in person before the Court, the Court prima facie found that the person whose photographs is annexed in the affidavit is the person who had appeared in person before this Court.

It is clarified that the Court on the said order i.e., March 9, 2021 had neither given any finding with regard to the genuineness of the applicant or his identity or otherwise.

The order was passed in view of the fact that lawyers were on strike and there was no one to assist the Court, except the person who had appeared in person.

The counter-affidavit states that the person whose Aadhaar card shows him to be Ajay Yashwant Nehru is actually one Prem Chand Sahu, son of Lalta Prasad Sahu, resident of 88, Gauhania, Ghoorpur, District Allahabad. Two Aadhaar Cards of the same number are on record; one is in the name of Ajay Yashwant Nehru and the second is in the name of Prem Chandra Sahu.

The Court after deliberations at the Bar directed the State to file the whole chain of title with regards to the property situated at 52/38, Hamilton Road George Town, Prayagraj as well as the details of property bearing number 52 ‘E’, Hamilton Road George Town, Prayagraj in view of two khatauni’s filed along with the application.

On the next date, the ADM as well as the responsible officer of Nagar Nigam shall be present in the Court along with the records pertaining to both the properties as recorded above.

Earlier, the Court has directed for providing security to the person who had appeared before the Court. The SSP, Allahabad is directed to produce Prem Chandra Sahu on the next date before the Court.

Both the above said persons shall carry with them their identification proofs. The Registrar General is directed to send all the orders passed by the Court to Vishva Prakash Srivastava, son of late Ram Chandra Srivastava and Savitri Srivastava, the wife of Vishva Prakash Srivastava, impleaded as respondents to the application through Email to ascertain their views with regard to the title of the property.

The Court has fixed the next date of hearing on March 24.
