Allahabad High Court grants short term bail to man to join his father’s 13th day ceremony

Submission of Counsel for the applicant is that the father of the applicant has passed away on September 06, 2021 after prolonged ailment.

The Allahabad High Court on Thursday granted short term bail to Upendra Rai, a resident of Deoria Kotwali area, to join the 13th day ceremony for his father.

A single-judge bench of Justice Naheed Ara Moonis passed this order while hearing a Criminal Misc  Short term Bail Application filed by Upendra Rai. The short term bail application has been moved on behalf of the applicant to release him on short term bail in Case under Sections 419, 420, 467, 468, 471 IPC, police station Kotwali, district Deoria during pendency of bail application.

Submission of counsel for the applicant is that the father of the applicant has passed away on September 6, 2021 after prolonged ailment. The applicant is the only son and as such he may be permitted to attend the 13th day (terahvin) ceremony of his father, which is to be performed on September 17, 2021, i.e. Friday. The counsel appearing on behalf of the complainant had no objection.

The Court ordered,

“In the facts and circumstances of the case, the applicant Upendra Rai is permitted to attend the 13th day ceremony of his father. For the said purpose, he shall be taken in police custody from the district Jail, Deoria to his native place on September 17, 2021 to attend the ceremony. Thereafter, he shall be brought back and be lodged in jail by 4.00 PM on September 19, 2021. During the said period, two police constables shall accompany the applicant and the expenses for the said purpose shall be borne by the state exchequer. The Chief Judicial Magistrate, Deoria shall give necessary directions in this regard to the District Jail, Deoria. An affidavit of compliance shall be filed by the Counsel for the applicant on the next date fixed.”
