Uttarakhand HC disposes of PIL against water-logging on village road

The Uttarakhand High Court has directed  the respondent authority to construct a proper underground pipeline as early as possible so that no water shall remain on the roads of Village Naseerpur Kala, Bahadrabad Block, District Haridwar.

The Division Bench of acting Chief Justice Sanjaya Kumar Mishra and Justice Ramesh Chandra Khulbe disposed of a Public Interest Litigation (PIL) filed by Amir seeking legal action against the private respondent for obstructing the flow of water causing serious prejudice to the life of public at large, because due to filling of water on public pathway, there is most probability of spreading several unwanted diseases (i.e. dengue, malaria and Covid etc.).

The State Government has already filed the counter-affidavit. However, on the direction of the High Court, they filed a letter issued by the SDM, Haridwar to the District Magistrate, in which demands have been made for a proposed underground pipeline with alignment at a cost of Rs 99.05 lakh.

Since, the District Authorities are already on the job of constructing pipeline that will redress the grievance of the petitioner, observed the High Court.

“We dispose of the writ application with a direction to the respondents to construct proper underground pipeline as early as possible, so that no water shall remain in the roads of Village Naseerpur Kala, Bahadrabad Block, District Haridwar, the order said.
