Defacement of properties during elections: Delhi HC issues bailable warrants to DU students for non-appearance

The Delhi High Court bench of Acting Chief Justice Gita Mittal and Justice C Hari Shankar on Friday (April 27) issued bailable warrants against a few Delhi University students who were not present in court today despite notice being served.

The bench directed that warrants shall be served through SHO Kamla Nagar who shall take assistance with the dean welfare of Delhi University. Further, the bench directed all the respondents to take preventive and remedial measure against the defacement of property done in the election.

This exercise must be completed by DUSU in two weeks, the bench said. The bench also directed DUSU to design posters, arrange Nukkad Sabhas, hold a painting competition or some other sort of plan to aware other students against defacement of property and materials required for spreading public awareness in this regard.

During the course of proceedings, the counsel appearing for DMRC submitted an affidavit estimating cost for removing the defaced property at DMRC. The affidavit estimated a total cost of Rs 16 lakhs required for refurbishment of the defaced property.

Another counsel said that the DU students have not the financial capacity to meet the same. However, they will put every effort that defacement not done in future and at present they will ensure to take steps for cleaning.

To which the bench directed DMRC to inform the students s about the defaced locations and ensuring effective steps for the removal of the same be taken by the all parties.

The bench listed the matter for next hearing to May 17, 2018.
