SC refuses to interfere in holding of Part 3 of exam

The Supreme Court bench of Justice S A Bobde and L  Nageswara Rao on Friday (July 6) said that it did not want to intervene into the process now and hence part 3 of the Common Graduate Level (Tier-II) examination will be held as per schedule tomorrow. The court added that the aggregate result will be subject to the final outcome of the case.

The case pertains to the leakage of questions of the exam. Senior counsel Prashant Bhushan, for petitioner Shantanu Kumar said that subsequent to lengthy preliminary enquiry the CBI filed an FIR posing allegations against the custodian of the question paper, Sify, which is a tech company outsourced by the authority to conduct the online examination. Bhushan said the instant grievance is that part 3 of the same examination is being conducted tomorrow.

While agreeing with Bhushan the bench suggested that the authorities cannot go on with the 3 part as if nothing has happened.

It is upon the clarification made by ASG Sandeep Sethi appearing for the authorities the bench changed its opinion and abstained itself from intervening.

The ASG clarified that upon discovery and allegations, the said tainted examination was cancelled and a fresh examination was conducted on March 9. His submission was that the FIR registered by the CBI pertains to the examination cancelled, in lieu of which a fresh examination was conducted.

Next date is July 13.
