The Delhi Assembly’s Privileges Committee on Tuesday (Sep 11) moved a petition in the Delhi High Court urging it to withdraw its direction to the Committee to video-record the proceedings against state Chief Secretary Anshu Prakash and submit it before the court.

KV Vishwanathan, appearing for the Committee today said to Justice Vibhu Bakhru that the filing of the said videography of the proceedings and the providing of the verbatim record of the same to the Chief Secretary (Petitioner) was in violation of the doctrine separation of powers.

Vivek Chib, appearing for the petitionerstrongly opposed Vishwanathan’s contention on the doctrine of separation of powers, arguing that the law is settled on the issue of the court’s jurisdiction to review any violation of a person’s fundamental rights vis-a-vis the procedural Rules framed under Article 208 of the constitution.

The bench said that the remaining issues including the court’s jurisdiction will be heard on September 18.

The Privileges Committee plea was filed in a pending petition of Prakash who had sought quashing of notice issued to him for skipping a meeting called by the Question & Reference Committee of the Delhi Assembly.
