Unitech hasn’t been able to disburse flat buyers’ money and hence should be taken over by govt, SC told

The apex court on Tuesday (Sep 11) was told that since the Unitech has not been able to disburse the flat buyers’ money, management of Unitech must be taken over by the government.

During today’s hearing, the SC bench comprising CJI Dipak Misra and Justices AM Khanwilkar and DY Chandrachud sought to know as how many properties of Unitech has been auctioned and how much money has been generated through auction.

To which senior counsel Ranjit Kumar apprised the bench that Calcutta property has been auctioned for 122 crore subsequent to a public disclosure. And the auction was conducted under supervision of the committee constituted by the high court.

Kumar suggested that the people seeking possession of flats should approach the committee as completion of flats will require money, and the promoters are in jail already.

The matter will be heard again on Sep 19.

  1. It’s now more than 2+ years and my salaries of 6months, Full n Final amount , Tax Deduction which is not deposited to Income Tax authorities and EPF which is not deposited to EPFO commissioner. With so many reminders to all stakeholdrss , nothing progress. It’s a clear case of collusion between Management of Unitech with Authorities concerned who allowed this to happen. Honourable Supreme must take the management in their control and make sure that all sufferers Home Buyers,Ex-Employees, UniFD investors, Employees get thier dues . Supreme Court must take similar action as done in BCCI case and make sure everybody being paid. Unitech has assets and forescenic audit should be done for all their assets and accounts .

  2. Besides Home Buyers Unitech needs to pay Ex-Employees as well Fixed deposit investors. Governement must take such giant like Unitech and pay back to all including employees whose salaries are delayed/backlog more than 9-12months. Tax Deducted from Employees n Ex- Employees are not deposited. EPF not deposited since Oct 2014 to EPFO.

  3. Courts are doing a tremendous job where all administrative & political institution have failed the home buyers & general citizens. How deep is the nexus of builders, politicians & government agencies can be gauged by lack of any will to resolve the massive public loot.
Unitech hires top notch lawyers to fight their fund diversion crimes but have no money to refund or complete projects.
Handover of projects to credible builders is now the only solution to this cancer.

  4. Parallel to auction of properties to refund flat buyers denied of justice, court should also hand over starting with the most complete projects to credible parties to finish houses for handover or sale under court supervision. This action is necessary as lots of idle capital is locked up.
Ekde find and fix credible cos who can take over this complete on work as in case of Satyam computers.
