Allahabad High Court asks for provisions on printing names of senior advocates in cause list

The Allahabad High Court on Tuesday asked under which provision are the names of Senior Advocates printed in the High Court Cause List and what right does the Junior Advocate have to postpone the trial if the Senior Advocate is not present in the debate.

The Court has asked to clarify the situation in light of the provisions of the Advocates Act and the rules made by the Bar Council of India and Uttar Pradesh Bar Council on these issues.

The Court appointed Senior Advocate Shashi Prakash Singh, assisted by Chandra Prakash Yadav as Amicus Curiae along with Senior Advocate Vijay Gautam, as to present their case on the issue.

The bench of Justice Vivek Agrawal has heard a Petition filed by Pramendra Yadav through Advocate Yadavindra Singh, appearing for the Petitioner. Senior advocate Ashok Khare has to argue in this matter.

The Court said that it has not been clarified under which legal provision the name of the Senior Advocate has been printed in the cause list. Whether the Senior Advocate will appear on the instruction of the Advocate taking instructions.

The Court said that the absence of a Senior Advocate for the arguments of the trial cannot be the basis for postponing the hearing.

The next hearing of the case will be held on January 15.
