Administrative Tribunals Act: Jammu and Kashmir HC directs petitioner to approach competent authority

The Jammu and Kashmir High Court has directed a petitioner to approach the competent authority to insert an appropriate provision in the Administrative Tribunals Act, 1985.

The Division Bench of Chief Justice Ali Mohammad Magrey and Justice Vinod Chatterji Koul disposed of a Public Interest Litigation (PIL) filed seeking a direction to the Respondents to insert the provision in the Administrative Tribunals Act, 1985 for filing a statutory appeal from the final decision/order of the Central Administrative Tribunal directly to the Supreme Court on the pattern of Section 30 of the Armed Forces Tribunal Act, 2007.

It was observed by the Court that the subject of the PIL squarely comes within the domain and powers of the Executive.

Therefore, the Court disposed of the PIL with a direction to the petitioner to approach the competent authority/ forum for seeking the relief as claimed.  

It is pertinent to note that the PIL was filed by one Jagdev Singh.
