Allahabad High Court directs government to take process of TGT recruitment to its logical conclusion

The Allahabad High Court has directed the Secondary Education Service Selection Board and the State Government to take the process of Trained Graduate Teacher (TGT) Recruitment 2011 to its logical conclusion. The court said that the recruitment process should be completed as soon as the board members are appointed.

A Single Bench of Justice Vikas Budhwar passed this order while hearing a petition filed by Indra Pal And 2 Others.

The case of the petitioners is that the third respondent, Secretary, U.P Secondary Education Service Selection Board, Allenganj, Prayagraj got published to advertise for the recruitment of various posts of Trained Graduate Teacher in different subjects including the subject Biology on 19.11.2011.

The petitioners claim themselves to be eligible and qualified in all respects they applied for the recruitment on the said post and the issued admit cards.

It is further the case of the petitioners that the written examination was conducted on 17.6.2016 and thereafter the final results were published on 8.1.2023.

The grievances of the petitioners are that despite the fact that the said selection is to be given her logical end while concluding it with most expedition but the same has not been concluded and after declaration of the result of the written examination declaring the petitioners who are being three in number to have cleared the same no further action has been taken.

Prayer in the petition is for a direction to the third respondent, Secretary, U.P Secondary Education Service Selection Board, Allenganj, Prayagraj to complete the selection process which is pending.

When the matter was taken up before the court A.K.S Parihar who appears for the third respondent has produced before the Court the instructions under the signature of the third respondent dated 15.7.2023 so as to contend that the petitioners had cleared their written examination when the result was published on 8.1.2023 however the board is non functional since 8.4.2022 and the chairman itself has come to an end on 8.4.2023 and according to him as soon as the board is constituted priority will be given for concluding the selections strictly in accordance with law after taken a conscious decision.

He further submitted that he does not propose to file any response in that regard.

Manoj Vashitha Standing Counsel, who appears for respondents 1, and 2 on the other hand submitted that in view of the duties and the functions entrusted with the Commission, the Commission has to conduct selections and lingering of the same would neither be in the interest of the applicants nor in the interest of the State Government in that regard.

He adopts the submission of A.K.S Parihar who appears for the third respondent and he spells out that when the board is constituted then they will take appropriate action in that regard.

Considering the submissions of the rival parties as well as stand taken by them, the Court disposed of the petition without seeking any response from the respondents on the basis of the statement made by the counsel for the respondents which includes Manoj Vashitha Standing Counsel, who appears for respondents 1, and 2 as well as A.K.S Parihar who appears for the third respondent that as soon as board stands functional the case of the petitioners with regard to the concluding of the proceedings pursuant to the advertisement dated 19.11.2011 given a logical end in accordance with law.
