Allahabad High Court gives interim relief to AIMIM MP Asaduddin Owaisi

The Allahabad High Court gave interim relief to AIMIM MP Asaduddin Owaisi in the case of criticism of the Ram Janmabhoomi verdict

The Court directed that no coercive action be taken against Owaisi till April 24 and sought a reply from the government in two weeks.

A Single Bench of Justice Rajiv Gupta passed this order while hearing an application under section 482 filed by Asaduddin Owaisi.

Counsel for the applicant has submitted that the applicant is being prosecuted for the offence under Section 153(A) IPC, however, necessary sanction from the concerned authority as contemplated under Section 196(1) CrPC has not been taken and as such, entire proceedings are bad in the eye of law.

The Court observed that the matter requires consideration.

The Court has granted two weeks’ time to file counter affidavits for the respondents.

“Till then, no coercive action shall be taken against the applicant in Complaint Case (MP/MLA) No 566 of 2022 (Rakesh Pratap Singh Vs Asaduddin Owaisi and Another), under Sections 153-A, 295-A, 298 IPC, Police Station Shohratgarh, District Siddharth Nagar, pending in the court of Chief Judicial Magistrate, Siddharth Nagar”, the Court ordered.

The Court has fixed the next hearing of the petition on April 24, 2023.
