Allahabad High Court imposes cost on Centre, State government for not submitting reply sought by Court

The Allahabad High Court has taken a serious note of the willful disobedience of submitting reply by the Central and State Governments, including the officers of the Income Tax Department and has given time to file a short counter-affidavit on the condition of depositing Rs 5,000 as cost within three days.

The Division Bench of Surya Justice Prakash Kesarwani and Justice Jayant Banerji passed this order while hearing a petition filed by M/S Up Pipe Fitting Supplier.

Despite the court detailed orders dated 28.03.2022 and 12.04.2022, the respondents are not filing even short counter affidavits. This shows a wilful disobedience of the orders of the Court, the Court observed.

Counsel for respondents prayed for further time to comply with the orders of the Court.

“As prayed, three days and no more is granted to the respondents to file short counter affidavit in compliance of the order dated 12.04.2022 subject to payment of cost of Rs 5000/- which shall be deposited with the High Court Legal Services Committee, High Court, Allahabad on or before the next date fixed”, the Court ordered.

The Court has fixed the next hearing of the petition on April 26, 2022.
