Bail denied to Nepali citizen accused of supplying confidential Indian defence documents to Chinese intelligence officers: Delhi High Court

The Delhi High Court has refused to grant bail to a Nepalese citizen named Sher Singh who has been accused of providing Chinese intelligence officers secret and confidential documents regarding India’s national security.

The bail was denied by the Single-judge Justice Anu Malhotra who said that whenever it is the national security of the country, there is no ground for granting a bail

In the order, it is mentioned that there is no ground for granting of bail and the bail application is declined.

The accused Sher Singh Singh has been involved in the espionage case along with the journalist Rajeev Sharma who was been charged under the Official Secrets Act as well as Section 120B (criminal conspiracy) of the Indian Penal Code (IPC).

The Delhi Police in its report has mentioned that the Nepalese guy, is the co-director of one of the Chinese companies through which the secret, confidential and sensitive documents were being transferred to Chinese Intelligence Officers by the journalist Rajeev Sharma.

It is also alleged that the transaction of amount for providing information was received through the Shell company where Singh was the co-director.

In his plea, the alleged Nepali Co director of shell company said that he has no idea why he has been implicated . He claimed to be uneducated , poor Nepali citizen, who came to India for a job and has been living here for some timenow.

He told the Court that he had come to India for finding a suitable job to cater to the needs of his family.

The accused has also said that he had no idea about the business going in between. He said that he was given limited area of functioning where his role was limited to pharmaceutical sector and he knows nothing beyond.

The Delhi Police told the court that the main accused, Rajeev Sharma was  involved in procurement of confidential/sensitive documents/material and information and its subsequent handover to Chinese Intelligence officers, and Singh was aware.
