Bombay High Court to hear tomorrow Uddhav Thackeray plea on holding Dussehra rally

The Bombay High Court agreed to hear on Thursday, a petition filed by the Uddhav Thackeray-led camp of Shiv Sena, seeking directions to the Brihanmumbai Municipal Corporation (BMC) for permission to hold their annual Dussehra rally at Shivaji Park in Dadar, Mumbai on October 5.

Advocate Joel Carlos mentioned the matter today before the Bench of Justice R.D. Dhanuka and Justice Kamal Khata, seeking urgent hearing on the same.

As per the plea, Shiv Sena had been conducting its Dussehra Melawa (Rally) at the Shivaji Park since 1966. It said in 2016, the BMC Commissioner had been directed to allow Dussehra rally at Shivaji Park and accordingly, permission was granted till 2019.

The petition further said that Shiv Sena did not organise the rally in 2020 and 2021 due to the Covid-19 pandemic. 

On August 26, 2022, Shiv Sena sought permission from BMC to hold the rally on October 5. However, the permission was yet to be granted, despite a lapse of more than one month, noted the plea, adding that this forced the petitioner to approach the High Court.

The workers and leaders of Shiv Sena throughout the state of Maharashtra as well as the country, arrive at Shivaji Park without any invitation or announcement, the petition further noted.

It said that while seeking permission from BMC, Shiv Sena had submitted an undertaking of compliance with various provisions of law.

It claimed that during the rally, there have never been any violation of conditions or disruption of law and order situation, since the event was organised in a disciplined manner by the party workers.
